We see the book back in season 3, in the same episode that Gale reads Walter the Walt Whitman poem. Walter is in his apartment reading that exact book. We don't know at that point that it's a gift from Gale, and I'm sure the writers hadn't hammered that out at that point, but it's a massive stretch to call it a cheat. It shows great writing on the part of the writers, taking something that we've seen before and giving it new context and meaning later on. That is how you make a serialized story work. And as far as Walter keeping the book, it entirely fits his character. His hubris that he can get away with anything is symbolized in him keeping the book.

I agree that Walt was careless with the book, but he also became so self assured that he would never be caught that he scoffed at something as simple as a book being the thing that could out him. Plus, and they never showed a 2nd bathroom in the house, but no one has been over for more than 3 months and perhaps Walt wouldn’t expect Hank to use the master bath. There are always flimsy plot elements to pick apart but the look on Hanks face makes up for it. You can start pulling threads from the best TV show or movies and suddenly you have a total mess, but all things being equal, this show does it better than almost all others. The only thing better than great writing is actual real life. Stories that make you say “you can’t make this shit up”. I’ve seen enough real life the past week. I’ll take a little fiction today.

They showed the book several times in this season only, because they knew they were going to have Hank find out that way. They never showed Gale giving him the book in season three, because they obviously didn't plan that far ahead. Which is fine, but really there's no way in hell Walt would've kept the book after he saw Gale's Lab Notes and the inscription there "To WW", which Hank had read to him, and which had matched the handwriting in his book. Way too big a risk to just leave that lying around. I know they wanted Hank to find out through happenstance rather than detective work, but they could've thought of something a little better. I always assumed Hank would see Walt and Jesse hanging out together. They were not really careful about that, they went out in public several times together throughout the show.

Well if people were aware, they would constantly be thinking about it. They made a point to show the book several times this season starting in the premiere I believe, and we know Walt Whitman has a link to Gale so it's still possible to piece it together.

There’s never a scene where Gale gives Walt this book, which is a shame. It’s a bit of a cheat, but I’ll forgive it.
