It explains better in the LN but not very clear in the anime... the scene in the end of ep 11 and the start of ep 12, when Shin and his brother were together, Rei had his data transferred to his spare unit (the one in the background of the scene and the one outside the window when Ernst talked to his subordinates) in the very last minute before Shin destroyed his original unit and somehow kept his own consciousness. He secretly followed Shin's team all the way and saved them from the Legion. He also brought them to the border of Giad and got destroyed by the army of Federacy in the end.
