To be fair, Hank would be doing the right thing if Hugo actually was the one he was looking for. Legally, he can't search his apartment, but he can search his car in the school parking lot to find any evidence about anything illegal. He found weed, so now he can get a warrant and search his apartment. If he finds the stuff, great he solved the case and can arrest him. If he doesn't find anything, he can move on to find the real criminal and not waste more time on Hugo. This is how it should work. If Hank was able to find Tuco and arrest him, because he happened to find weed in Tuco's car, we would be happy for Hank to find any evidence and eventually get him off the streets. The problem is of course, Hugo already has a record and they also find more weed in his apartment, which is enough to get him thrown into jail. At this point Hank can't just ignore everything he found and not do anything (basically because of the warrant, nobody would care if he ignored the blunt in the car), Hank doesn't decide what the laws are. Whether Hugo will actually serve time or not is up to a judge at this point, there's nothing Hank can do. But obviously, the circumstances look really bad, especially with the racial component and it doesn't help that Hank is so jaded that somebody getting "a little prison time" isn't a big deal to him, while this could ruin Hugo's life for decades. (Well, he could advocate for Hugo with the judge which undoubtedly would help, with weed he could probably get it down to probation. But no DEA agent, especially one as high up as Hank would bother spending "political capital" with a judge for a random weed possession case he didn't even want to find and won't get him anything in return.) Having said all that, poor Hugo. Suffering consequences of Walt's crimes after cleaning up his vomit multiple times.
