As a general proposition, those laws have a scienter requirement. So you have to knowingly or intentionally violate it. They will try to infer intent from X and Y, but it needs to be proven beyond a reasonable doubt in a criminal case. In most instances, the initial responding officers will coax a confession in some form out of the defendant.

Nice bike! Decades ago I had a Yamaha FZ-600 that I used to race (on the track, not the street). I’ve heard all kinds of entertaining things from FFLs, the most common being “it’s illegal for an FFL to accept a transfer from a private individual”. Since I occasionally sell something from my collection online this one drives me nuts. I do have one question about your Constructive Intent video. You said that the ATF can only prosecute if you intend to make an SBR without paying the tax; how does the ATF know what the intent is? I would love to hear the history of the NFA.

It was in great condition, 2013, 12k on the clock, checked out. He decided to go for it, so me and the old GMT400 hauled it back down south for him.
