‘Run for Something’ Is Stronger Than Ever. We’re Going to Need It.

OA 1130 and T3BE60 - We're so excited to kick off this episode with an interview with Amanda Litman, the co-founder and President of an amazing organization called Run for Something. We discuss who they are and how they support folks in state and local races in all 50 states, answer questions for those who may be listening and considering throwing their hat in the ring to run for political office, and get energized from Amanda's contagious hope for what can very much come in 2026 and 2028 if we put in the work now.

The answer is D. I think the answer should be A, but I'm going to guess there's some 13th century Saxony law this question is testing. A feels so obvious that it has to be a trick. I also think this is something that should've been addressed in the contract. I might be wrong here, but I'm going out swinging.

I'm gonna guess B, because real property is whack and B is the only answer that accounts for the fact that the corn was partially grown Wendy's farm and partially grown on Gerry's farm. The whole question is surprising though, because it's specific and weird enough to suggest it's probably referring to a specific case but how would you possibly get case law on this when you'd OBVIOUSLY JUST PUT IT IN THE CONTRACT?

I want to rule out C, because the law having “she has to pay a fee” baked in seems dumb. If it was A, they wouldn’t ask about it. I’m going to say D, because “everyone can just share :)” is not how the law seems to work in 90% of other cases, so why would it be the case here?

Ooh, is this like that famous case with the two hunters arguing over a dead fox? Okay, I just googled it, and no, this is nothing like Pierson v. Post, lolz. Never mind. Anyway, I think Wendy gets to take her corn, man. She paid for the seeds. If I sold a house and left something valuable behind, the new owner shouldn't get to keep it just because I'm forgetful. Maybe she forgot about her corn. You don't know. Finders keepers can't be the law. So yeah, going with D.

As a non-lawyer, the intuitive answer is A. But, being a real property question, going on intuition is a bad idea. I am not familiar with what the law says here, but I'll go with B and come up with a way to make it make sense: If Wendy had buried treasure on the property and forgot to dig it up I could believe she may have a right to retrieve it, as it would not be reasonable to assume Gerry knew he was buying property with buried treasure on it (although there may be a timeliness requirement). However, I feel the detail about planting 20 acres of corn is important here - it was included to make it clear that the presence of the corn crop was obvious to both the buyer and seller. To me, both the buyer and seller are equally at fault for neglecting to address the sale of the corn (and I would take a clause about selling the property "as-is" to count as mentioning the corn crop), so it would make sense for the resolution to be that both have a claim to the corn.

Lawmakers love farmers. Fixtures are fixtures if they are affixed to the property. Wendy’s crops, however, are not fixtures to the property. Think about it like you are attending the showing of a house and you buy the house on the spot. You DO NOT own the couch, armoire, or picture frame’s of the previous owner. It’s a separate bill of sale. Wendy gets to come by and pick up that season’s crops.

I think Thomas is right, and I'm also going to go with A: if Wendy just went and took her corn back at this point, I'm pretty sure that would be theft because the corn went with the property and wasn't addressed before the sale.

Off-by-one error

Good luck! I ran a few years ago and ended up withdrawing because there were several progressives in the race and one nazi and splitting the progressive vote was clearly a disaster, but even being in just for a bit was interesting and valuable. I hope you also find the process worthwhile.
