Clarence Thomas Loves Killing Potentially Innocent Men

OA1078 - The Supreme Court is back from their vacation and is set to ruin a bunch of lives again! They start off with Glossip v. Oklahoma, another opportunity for the Republican ghouls on the Court to execute a potentially innocent man.

But not to worry, Matt's Footnote Fetish(tm) will bring us wayyyy back into happy territory, as a favorite character from OA past is in the news in the best way!

Check out the OA Linktree for all the places to go and things to do!

We must respect the process by doing absolutely nothing to make sure the process functions.

I would really appreciate a more thorough review of the facts of a case like this before the commentary regarding how abhorrent it is. I rewound part of this episode two or three times trying to figure out who is who. It was like trying to parae a sentence with two double negatives.

Okay. Idle curiosity here. What if it gets sent back as that the death penalty stands and the state just.. doesn’t do it? Like sets the execution date to 2324 or the like. Would that be a way around things or would a court be able to come in and say “no, kill that guy this instant”

Jinx Greymoon

I still don't get it I'm sure I'm missing something but I couldn't find anything about a new date having been set for his execution. So just... don't schedule it? Even if they've put him on a Bond villain conveyor belt thing, the governor pressed pause but nobody is allowed to take him off, who exactly is trying to switch the thing on again? It's like begging your right hand to prevent your left hand from punching you in the face. And there is a weird sense of fake inevitability like they've fired him into the sun and would need funding for Spacex to go get him. I'd say Clarence Thomas should have to go and kill the guy himself but he would probably do it.

Oh that footnote put such a huge smile on my face. Thank you for that!

I meant to say that the Pardons and Parole Board already denied clemency (despite the Republican AG personally showing up to request it), which means that the governor (who seems much less committed to this than the AG) can only stay the execution. He has already granted multiple reprieves and has said that he will only grant another if a court intervenes. (A commutation of the sentence would also have to go through the same board.) The attorney appointed by SCOTUS was there to represent the OK appellate court since the AG refused to defend their decision. It's all really weird and confusing!

Matt Cameron

I must have missed some part of this explanation because I'm still utterly mystified by this. The question raised by Glossip is "wait, can Oklahoma still murder me after all this bullshit" and Oklahoma's response is "no you're right it's bullshit". How did this even get to be a case? Why was there some guy assigned to it, like it's high school and the teacher had to make someone argue pro That exams are awesome and a great way of deciding who is the best at stuff? Who is the assigned guy even speaking for? Did the God of Finality appear to him, appoint him Champion and bestow upon him the Sacred Syringe of Sodium Pentothal? How would Glossip even get executed without Oklahoma intending to execute him? Just... don't book the murder room. Don't get the murder drugs out of the fridge, don't pay the guy with the hooded mask, whatever. Is this a publicity stunt for Final Final Final Destination? Logistically how does it even make sense?? Did the family of the victim arrange it somehow? You really couldn't ask for a clearer argument against the Victims' Rights movement. What.

Such an excellent episode ETA I think I'm going to re-listen to it too

OK, wait a minute. What exactly is haunted in Matt's house!?!

NSaneAtheist

I feels like even the Vogons would say this level of commitment to correct bureaucratic procedure is a bit much

General Contact Unit Problem Child

That letter was amazing. “Roy Writes Wrongs” is a newsletter/podcast/any form of media that I would live for

Nathaniel Field

The Roy Barnes letter to hysterical Gym Jordan is one of the best things I’ve ever heard! Jordan does not deserve to be taken seriously but should be told to calm down. All. The. Time.

Kristen Leist

Thanks for covering this case. Glossip caught my eye a while ago.

That was OA1007, the second half of our coverage of the Fani Willis removal hearing

Matt Cameron

Any chance sharebannedbooks.com could go on the link tree?

Could someone please point me to the episode where Roy Barnes is in the Ga case? I I would love to go delisted to it! Thank you Matt and Thomas for ending on a lighter note.
