OA1037

THE JURY IS IN! Opening Arguments is coming at you LIVE AND UNEDITED today as we react in realtime to the announcement of the verdict in People v. Trump--conveniently timed for exactly the time that we had already planned to record this week! We also take a look at the lengthy closing arguments from both sides and Matt answers patron questions about some of New York’s more unusual trial practices before getting into what we can expect next.

We finish out the fun with Thomas’s dramatic reading of Samuel Alito’s indignant, mendacious, and entirely unsolicited response to the Senate Judiciary Committee’s demands to speak with the Supreme Court’s manager and take a moment to appreciate his full-throated defense of a woman’s absolute right to choose (flags).

Also as of now we're nearly to that point in Gavel Gavel so I'm sure we'll explain more then

Matt Cameron

idk why Patreon just decided to show me this post now but so long as I'm here: totally normal! It's routine and expected no matter what the evidence was, just one of those things you do for the record

Matt Cameron

Thomas & Matt I know I am late but that is the point. The day of the verdict I couldn't be involved in something that I have been looking forward to for nearly a decade now. Getting to hear this unedited was like getting to hangout with friends, old friends and new. I had a party of me and a podcast but it was better than nothing and I honestly than you from the bottom of my heart.

Autistic Dilettante

At the end of the trial, the defense moved for a judgment notwithstanding verdict to acquit Trump. Is this a thing that defense lawyers tend to ask for all the time (like, I think, how they usually ask to have the jury polled) because there's no downside to asking? Or is that more unusual?

Sam

mine doesn't scroll quickly, but it is still a beautiful jenny-holtzer-style piece of art that is a ticker of guilty guilty guilty forever... :)

lauren

If you start listening to this in the Patreon app, then back out of the episode page so it just shows the miniplayer, the title scrolls by hilariously quickly. I think they decided the title had to scroll fully in X seconds, and 34 is a lot of Guilties to get through in that time.

MY FLAGPOLE MY CHOICE!

Alex Cruise

Law360 has uploaded it here: https://www.documentcloud.org/documents/24706628-trump-verdict-sheet

Shad Riley

Can you upload the verdict sheet so we can see it? Cheers!

Lisa Redmond

It was great, do not stress about it.

Maria Kladaki

also: the OA stormy-legal-genius to guilty-verdict timeline is one hell of its own yodel mountain. dual timeline movie huzzah!

lauren

https://youtube.com/clip/UgkxhcFcWxdkO3r8KZZb-nkGhRLc57bjvZlK?si=6G4Tbgne1MMGjci- that motherfucker's guilty

lauren

I feel like we could easily prank Thomas by all piling on about how awful it sounded, but in reality it was fine. Good call prioritizing getting this out quick.

Gmork

I think a better defense lawyer would have described Cohen as an average liar, a dime-a-dozen fibber, and a common prevaricator. "Greatest liar of all time" just adds an unnecessary level of superlative that Blanche didn't have to try to prove.

In the words of Adam Savage, “I’m going to need a grin-ectomy.” I know there is a lot more to go, but seriously this made my day, probably will make even more days. This will be my mental Prozac for a while whenever I’m upset at something.

Richard Stifle

The drug tests alone . . .

I disclose that I'm a lawyer with a service dog in the jury duty questionnaires that I receive (two different check boxes!) and, weirdly, have never been called to serve. (Sorry for comment barage, admittedly giddy about the outcome today). F-ing Alito. That letter. Woof. Women can't have control over their own bodies but heaven forbid anyone contend with their flag-based speech.

Katie Herrmann

Sorry. Me again. Just picturing Trump popping dirty and giving his resting scowl face.

Katie Herrmann

Yodel away, friend!

Katie Herrmann

Illinois lawyer (not trial) here and thought I was just misremembering that that's how it went.

Gmork

What would probation look like for Trump? I fear that like with the gag order, it'll just be an exercise in getting endless extra chances before it's revoked.

Gmork

So glad this happened.

Katie Herrmann

Picturing my teenage self in front of a PO: "I smell like cigarettes? What? That's crazy. That's a thing ya'll check for? Yes, I am 16. I'm just saying. My dad smokes in the car I drove here. Like a lot. You wouldnt believe. Just, all the time. My car is like, the main smoking location for adults. Who do it legally there. I've tried to stop them but, you know... adults! Frankly, I'm offended you even noticed. Because of the circumstances. That I just explained.")

Katie Herrmann

Would love to confirm that he can be sentenced to up to 4 years in prison max (I've seen pretty major news sources report this as 4 years x 34 counts, or 136 years total possible- and I can't imagine this is accurate/that sentences wouldn't run concurrently).

Katie Herrmann

Absolutely. A PO would be ruining Trump's repeated days if he were treated like just some dude. Baby steps, I suppose.

Katie Herrmann

My favorite use of the yodeler yet!

Cameron

Wonderful - thanks for the unedited release 🩷

Martin (@TheButtonz)

It felt looser than the other episodes, if that makes sense, but it’s a candid and enjoyable listen

Matt McLain

🥳

IS SHE TALKING ABOUT ME

"Trump's Probation Officer" is the perfect new reality TV show. Each week would be full of all the eye-rolling hilarity and horror as he recounts all the civil claims he's lost over the years, all the bankruptcies, all the bullshit products. One claim per episode and I'm sitting on a goldmine!

Everything Important

If Trump actually had to undergo probation like a normal person, he would be totally screwed. He can't stop doing all the shit that a probation officer jumps on your ass for. I'm pretty sure there have been a lot of allegations that he wouldn't get a clean piss test amongst other things.

I’m loving this unedited content

Megan Muse

Ah, thanks, I haven't had a chance to actually listen yet, but glad to hear it!

Graydon Armstrong

Greatest Loser of all time?

Tobinite

However it may have started, Yodel Mountain is an OA thing now. And this episode includes yodels, so yodel away!

Quark Twain

I've been waiting to hear those dang yodelers for years now! If they put him in a jail cell, I would like to request that you guys record your own yodeling for the episode.

John Hirsch

The GLOAT 😂 I liked that one too Thomas

Andrew W

For the jury taking 30 mins I bet they were just reading each charge and affirming. I was on a jury that convicted a public official and, even though we were all sure, actually filling in the verdict forms felt very solemn and weighty. We just needed to re-read each charge to be confident we weren't missing something.

Tobinite

I've had the worst week but let me tell you I've had the best day today 😁

Tobinite

Thomas I would love to have you do a webinar on editing.

Travis Alexander

In Illinois it is Prosecution close then defense close and prosecution has a rebuttal close. In my courthouse (I am a public defender) the prosecution rebuttal really is not limited, so feels like prosecution gets last word.

Jena Jones

YODELAYHEEHOO Edit: If Yodel Mountain was a PAT thing, LMK and I'll remove this.

Graydon Armstrong

I don't see how this could have taken 30 minutes either: https://www.nytimes.com/interactive/2024/05/30/nyregion/trump-trial-verdict-document-manhattan-criminal.html

Despairing Radical

Or he had it prepared ahead of time, like famous people's obits, or the other Apollo 11 speech.

Graydon Armstrong

I just would like everyone to know how much I hate releasing unedited audio. I think it was necessary here but I hate it. I always take out like half of my jokes and since Matt is impossible to hear, I smooth out where I'm talking over him and stuff. I hope this is enjoyable audio somehow lol

Opening Arguments

Damn Thomas must have recorded this two seconds after the announcement and edited the whole thing in 20 minutes 😂 Really putting the "rapid" in rapid response!

Blue Gemini

I choose to believe that the title, while numerically accurate, is also a Spies Like Us reference.

Philly Basement Bar is back open, and isn't taking this shit lying down.

EVERYBODY HAVE A BUNNY!!!😃😃😃😃😃

Karaoke LEGEND Cosmo Blues

This is exceptionally impressive! 👏👏👏 It hasn't even been two hours!

Lisa Marie Chambers

The jury asking for David Peckers testimony felt like the biggest signal that they would find Chat DJT guilty

Matt McLain

Great. No waiting for Rapid Response Friday! Woooooo

m1st3rk1ng

So so so happy to celebrate with you. What a great day!

Wishing every Clarence Thomas a very God rest his soul

I'm on the phone with my friend and he's singing "Oh Happy Day", lol.

Timothy Thayer

Thank you for putting this out!!!! Listening. EDGE of my seat

YES! USA! USA! USA!

I think you missed a guilty in the title :). Oh wait nope that is 34.
