Apparently there was a ProPublica story about Trump paying generous financial benefits (pay increases, bonuses, severance packages) to potential witnesses against him, sometimes with the explicit condition that they not voluntarily cooperate with law enforcement. Could that be obstruction? And even if that is not illegal on the face of it, could it be illegal because the payments are not actually what they claim to be (if they're really a payoff for destroying evidence, giving false testimony, or whatever).

Hello, Dr. Nick!
2024-06-03 04:38:23 +0000 UTCI don’t have any news suggestions, but can each episode start shouting out to donate to the American Constitution Society? It’s the liberal version of the federalist society, and they’re working their asses off to verify good judges to be appointed
Hello, Dr. Nick!
2024-06-03 04:37:32 +0000 UTCIt's not going to be a rapid response Friday, but I'd love a deep dive into competency restoration. I knew it was a thing, but I never knew just how long it takes, that people can be held in competency restoration longer than they would have served if they had just been allowed to plead guilty. Also, is there a competency standard in immigration hearings and how is that handled?

2024-05-31 22:31:29 +0000 UTCMy understanding is NYS allows felons to vote unless they are actually sitting in prison, and FL defers to the laws in the state where you are convicted, so he 100% can vote in FL this year, no law change necessary.

2024-05-31 14:00:04 +0000 UTCI'm writing this down once so I maybe don't forget. I would be interested to hear Matt's thoughts on the fallout of DeSantis' political stunt years ago now. The stunt where he lied to immigrants and flew them to Martha's Vineyard. Given it's Matt's stomping grounds physically and in law practice, I would be very interested in his thoughts. Cheers

2024-05-30 21:27:54 +0000 UTCGuilty on ALL 34 counts. I don't care if there's much analysis to be done. If Thomas wants to just do some ASMR of him reading each count followed by GUILTY for all 34 charges and then loop that for an hour I'll be happy. Throw in some random THEY GAGGED ME! soundboard clips and I'll bump up my membership.

2024-05-30 21:15:08 +0000 UTCI have a batshit dumpster fire that might be good for a future episode. The Romance Writers of America (RWA) is filing for bankruptcy. Romance is the largest segment of genre fiction and RWA provided community, competitions, exposure, resources, and lobbying and advocacy for authors. They are a BFD in the publishing industry and everyone is losing their shit. But not because of the bankruptcy, but because of the reason stated within the filing: DEI. And of course, mainstream media picked up on it and ran with it. They've also name a specific author as the cause, Courtney Milan, and I'm sure this is the kind of publicity she could do without. Industry media such as SmartBitchesTrashyBooks.com immediately threw up all the red flags. TLDR: RWA has been having issues with institutional racism, and they lost a huge portion of their membership because of it. They suspended a popular author of Asian descent for violating their DEI policy by saying a book by another author contained dangerous racist tropes. They also gave an award for a book where the hero/male love interest was a soldier at the Wounded Knee Massacre. Not kidding, and it gets worse the more you look at it. The SBTB article with links to previous reporting and the bankruptcy filing can be found here: https://smartbitchestrashybooks.com/2024/05/rwa-has-filed-for-bankruptcy-and-youll-never-guess-why/

2024-05-30 17:32:11 +0000 UTCAlso progressive but I respectfully offer this. The state has the burden of proof *beyond a reasonable doubt between 12 strangers*. It's the State's burden from initial investigation until the jury gets the case. That's a pretty high bar if you're talking about twelve strangers coming to unanimity. The defence has to only create unreasonable-but-still-maybe-perssuasive -doubt in one juror to defeat the state. Since the defense is part of jury's deliberative process, and the state has the highest burden, it makes sense to me that the prosecution should have the ability to incorporate the defense arguments into their own closing.

2024-05-30 16:23:55 +0000 UTCIdk if this is the kind of rrf you're looking for, but I need to vent about TT jury coverage and this seemed like a good place to do it. I'm kind of appalled by almost all quality legal analysis of the closing arguments by prosecution. I feel like reporters and analysts are very much substituting their own perception that State's closer was too long or too detailed. I'm a JD and served as a fore on a double homicide plus one attempted. What I heard from the TT prosecution was a detailed road map for the jury. While it is a complex case with 37 charges, it is easy for me to imagine deliberations going something like, "OK, fellow jurors, do we think the prosecution summary on count x, combined with evidence y, is proof beyond a reasonable doubt. Discuss." My point: He told them how to think to get beyond reasonable doubt. And as a juror, I WOULD EAT THAT UP AND ASK FOR MORE. Not only to give myself moral clarity about sitting in judgement of another, but also to persuade any fence-sitters, eg "Holdout Juror, you heard the same thing as we all did, that, (cites pros closing), and here are the documents. What are you thinking and why?" Also have to say jury deliberations are awesome in that you can be completely honest in expressing your feelings. You're with a group of strangers who have gone through a shared experience with real consequences for another person. I'd do it again in a heartbeat, bored moments and all. Rant ends. Thanks for listening. Now I can get on with my day, so thanks for that!

2024-05-30 16:08:45 +0000 UTCMy non-lawyer, non-political scientist thoughts - it's a "tough on crime" thing and those are typically hard to change. But I wonder if they could do something like a redirect or like a debate format where the defense gets X minutes to reply to the prosecution's closing arguments and then the prosecution gets some shorter amount of time to respond to the response

2024-05-30 11:05:27 +0000 UTCI'm way too late to the party, and I imagine most folks don't care about this, but baseball. Angel Hernandez was hated as an MLB umpire for basically a decade, and he sued MLB for discrimination. This week a video was published about him, and within days, Hernandez "retired." It's got union issues written all over it, and my suspicion is that MLB paid him a hefty sum of money to just go away. Baseball law! Bring it back!

2024-05-30 06:48:08 +0000 UTCI posted before reading this comment. When I was on a jury I was surprised and upset that the state got the last word. This is totally a case where I would be thrilled for Trump to get what he wants and for it to benefit many more poor and under resourced defendants.

2024-05-30 02:13:00 +0000 UTCMany years ago, I was a young progressive on a jury and I remember being pissed that the state got to go last for closing arguments. Now Trump is making the same argument. Why is it such a terrible idea to allow the defense to have the last word?

2024-05-29 22:41:28 +0000 UTCObviously trial coverage stuff is gonna end up in Gavel Gavel, but I'd love a realistic look at what sentencing will look like if Trump is convicted this week. Jail time is possible but unlikely many say, so what are thinking? House arrest? Community service? Genuinely unsure.

2024-05-29 21:26:30 +0000 UTCI'm interested in understanding better the impacts of potential verdicts in the Trump NY Hush Money Election Interference trial. Some examples of questions I have if a Guilty verdict is reached on some or all of the charges and what this actually might mean. It seems unlikely that he would get actual prison time, likely probation and a fine? Is that right? Does NY State law allow for 30+ felonies to get probation only or is there some minimum prison sentence that would apply? We know it doesn't disqualify the President from running for office, but would this interact with Florida laws that would disqualify him from voting in the November election for himself? Is he likely to be released pending appeal? If he's on probation would he have his passport revoked? If he gets away with just probation for say a year or two, would a guilty verdict in another court qualify as violating his probation?

2024-05-29 20:30:11 +0000 UTCOne of Trump's ridiculous attempts to make himself into a victim was complaining about the prosecutor making their closing remarks last. From what I've read there's a couple of different orders in widespread use across different states and other jurisdictions. I'd love some opinions, maybe even a defense vs prosecutor "debate" re: which order is favored by each side. Some objective info regarding any analysis that has been done on the influence of this order on conviction rates would be appreciated too.

I know that this maybe won't be first priority, but if you ever delve into the cases against Live Nation (ticketmaster parent company) will you please check out legally the Senate's letter against liberty media (ultimate parent company) regarding its denial of the andretti bid to enter Formula 1? I am a huge fun of F1, but the content I follow cannot provide a legal aspect. Some people are making parallels between f1 and NFL, but f1 is international and I do not see how the US DOJ can have really a say.
