We only do the question on this one, since we did both the Q and A last time. So, this is just a short little uncharged episode to get us back on track. It also allows me to catch up on Patron thanks!

Thank you for clarifying the new liz for gavel gavel. when I heard her name on the friday ep I was *very* confused and wondered if I'd missed some kind of $5 feud reversal. also: I'm gonna go with D. I think the owner still has the right to refuse, but I suspect that it can't be for personal (or possibly discrimatory) reasons that edge into competition/consumer rights/etc. I love the wording of C, but have a feeling it might belong to sub-contracting/non-compete, rather than premises.

Heather is awesome! Actually I would kinda prefer a format where she "spoils" the question right after you answer it. But I understand that many listeners like playing along and not having the funny/cool/original answers from listeners would be a loss.

Heather is great! Love her as the new T3BE Examiner and I'm very much looking forward to the explanation on this one. I thought the new format was going to be question + answer in the same episode, though? That was very cool in Episode 25. I suppose people want to "play along," and "engage via social media," and ". . . etc."; but I really enjoyed the all-in-one T3BE, so I vote for that in case that's a thing people are allowed to vote for.

Of the people who were on OA more than a handful of times, he is the only one I know of that never commented on the scandal publicly. He maintained his follow of Torrez/OA during last year on twitter at least. I think he might've namedropped OA a couple times last year as well but memory fails me. This year he gave an on-air promotion of Liz Dye's L&C as soon as it started as a podcast after her departure, and now is featuring her as an on-air Trump correspondent. It is possible he's just taken a "centrist" approach and just also likes Liz Dye. Or even that he somehow kept his head in the sand and doesn't know about the accusations. But I think it is most probable that he has sided with Torrez to some degree, and his support of L&C/Liz Dye is a more publicly acceptable proxy for that. There's room for nuance and this is an uncharitable interpretation toward him, but I think a reasonable one. It is disappointing, because after Thomas and maybe AG, Devon's voice would've been the most powerful one for calling out Torrez's behavior.

E. I object to the form of the question. No *argument* is likely to *compel* the owner. Rather, the question should be phrased as which is most likely to *succeed at court*, where the *court* will then compel the owner. The owner could be an unreasonable prick, who won't be convinced by *any* specific rationale, and the question is impossible to answer without a psychological profile of the owner. Also, I renew my objection to multiple choice questions and tests as a format for assessing actual knowledge. Aside from that, I'm leaving the actual substantive answers to the non-lawyers, and will instead hazard a guess that this will have something to do with the presence or absence of certain "boilerplate" language in the agreement, which also was not specified in the question and only further serves to underscore why multiple choice tests suck ass.

Philly Basement Bar is back open, and isn't taking this shit lying down.
