I was wondering if you’d ever had anything like that happen with a client, how common it is, and what other states are doing about it.

Since this is foreign and interstate commerce, doesn't the federal government have authority to conduct these inspections? Are these "enhanced inspections" preempted by federal law?

2024-05-01 21:47:56 +0000 UTCHi Ruari, just wanted to respond to this since you've requested it before--Casey and I have been watching the Read case closely for awhile and we will likely want to do an episode on it after the verdict AND we find out why the US Attorney's office has been investigating the Norfolk DA's office. I was very surprised to realize recently that this case is receiving international coverage, but if the US Attorney is looking into anything to do with how they handled this investigation--and as I'm sure you know it does seem there were any number of really serious issues with it--then this story could potentially become so much bigger and I'd rather wait until we have the full picture in front of us. (It's also quite frankly a risky thing to talk about in public right now given the extremely--well let's go with "energetic" activists who have had a lot to do with driving the coverage.) Thanks for the suggestion!

Lets say a defendant says he was acting on advice of counsel in one trial and then in another trial he said he never did that or a defendant goes on the stand can his statments be used against him in another trial?

2024-05-01 21:11:03 +0000 UTCSo this topic is one that I have been wondering about since a previous years ruling by SCOTUS but may be very relevant to what happens in their immunity ruling. What happens when SCOTUS makes up facts for it's ruling? Like they did with the coach from Washington previously where their ruling centered around "allowing quiet prayer" which was not the issue being reviewed. If they do the same thing for trump, saying that the executive is totally immune and thats why he can't be sued for his acts as president and that the case should be dismissed, despite even trumps lawyers admitting that some of the acts were private. What happens? How do judges use a ruling that is unrelated and even contradictory to the underlying case?

So the numbers are in Trump’s favor for a hung jury." So after all this getting our hopes up about justice finally arriving, a likely MAGA person is on the jury. Maybe they'll wake up in light of evidence they haven't been seeing until now, but I worry about devotion to the orange grifter that seems possible for someone who has thought it was a good idea to get most of their "news" from Trump's social media propaganda platform.

I was also interested in dept of state vs Muñoz as Matt is an immigration expert. Lastly, since it’s Friday, why not cover the new Texas porn law the Supreme Court did not issue an emergency stay for.
