T3BE Week 7! Best Evidence and Contract Law

It's week 7, and it's a Next Generation of test. Make it so! Oh also, we're still dogged by controversy, #T3BEgate2.5 but we've got a fall guy and it's Matt. Question 12 was a repeat and Matt is to blame and accepts the inevitable public shaming. But 13 was new! And, now we've got an entirely new kind of test!

T3BE Week 7! Best Evidence and Contract Law

Funny to have "what is the rule of law?" come up, since Garland's answer to that question was in the opening quotes for so long.

Well, I applied to just about every single library that was hiring that I could reasonably commute to (the librarian job market is tough in the PNW), and this was the one that finally worked out. I had no law background and didn’t know what to expect, but it turned out to be the best job I’ve ever had.

So happy to hear you refer it as Twitter! It's familiar and way less jarring than calling it X

I know that this is not necessarily a legal question but wouldn’t it make sense for TFG to pick Haley as his VP to try and pick up her voters? I’m really worried that this is his best chance of winning.

Not that millionaire

How did you get this awesome job?

Yes, I did just pull a "Webster's Dictionary defines accord and satisfaction as...," but it got me where I needed to go.

As a non-lawyer who works at a law library, I have shameless used my access to Lexis+ to run all of the searches. The answer is A. In an Ohio case called Dawson v. Anderson, the court defined it as such: "An accord is a contract between a debtor and a creditor in which the creditor's claim is settled in exchange for a sum of money other than that which is allegedly due. Satisfaction is the performance of that contract." As there were photographs of the stains, there appears to be a good-faith dispute regarding the services rendered in our case. If the client cashes the check knowing the customer intends it to be the full payment if cashed, it would become a binding accord and satisfaction.

This is an even bigger scandal. First they posted questions that were used 2 years ago. Now they are posting the same questions from last week! This is just blatant pissing in our faces and telling us its raining!

Dreadsen

Looks like the photos here are the same as last week's, and not for the new questions.
