Oh i was trying to say 1) thank you for this, i did miss it! and 2) this is incredibly sloppy and i definitely would have mentioned it if i had caught it in my review of cannon's many, many judicial sins-- but not necessarily as directly concerning as the courtroom closure issue, which shows an appalling ignorance of the law and basic trial practice

It is extremely unusual to have a judge recuse just because they were overruled but it is also extremely unusual for the same judge to be overruled twice in the same case within a few months. Recusal is the only vehicle here, and it's not unheard of when the judge has been publicly embarassed by how badly they have handled something

Would Matt’s suggestion that Smith move for Cannon to recuse just be based on the 11th circuit overruling her twice, or general incompetence? How often does that motion happen? I think of “recusal” as being an action the judge takes for either conflict of interest or personal health-type reasons. Do judges ever tap out of cases because they don’t understand specific aspects of the law?

Here's another thing about Cannon. There is speculation that she denied the motion to dismiss without prejudice for a specific reason. Matt, what happens if the defense files the same motion again after a jury is seated and she grants it? I believe jeopardy would have attached and then the government can't appeal and can't charge him again. If she had granted it before the trial started, the government could have refiled.

I’ve been over my head intellectually before. Seems like she is and is defaulting to not making any decision that would antagonize Trump because … well… Trump is a bad enemy. Safer this way if it’s a coin toss (in her mind).
