Thomas Takes the Bar Exam Week 5!
Ok so last week revealed to us that the "hot unbreakable streak" was not, in fact, unbreakable. No one could have seen this coming though, so no use in playing the blame game. Thomas comes into the week 5-2. Will he go to 5-4? Or 7-2? Or perhaps the other possible record? Find out!
Then, we get 2 new questions! It's personal injury, and also... personal injury? Maybe? We'll see!

I actually think this isn't a good idea. It reminds me too much of the bull shit people pull with trans people. I know it's not literally the same, but the logic is pretty identical. "oh but I've always known you as [deadname]"
It's his dumb company that he is financially ruining, he can name it whatever stupid ass thing he wants to.

Seems like it's not the same question. First was a question about suing the corporation, this was about suing the daycare.
However, the Firefighter rule question was a repeat.

Did you see Kait's comment that this is *not* an exact repeat? Same fact pattern, but this is about a suit against the daycare, the earlier was about a suit against the corporation. Sounds like you're in the clear after all!

Personally, I don't think it's reasonable to expect all T3BE questions to be new ones, especially considering the Shenanigans; I am sure you have places to be & people to help get green cards instead of validating that!

Hi everybody, I haven't had a chance to listen back to the last time this question was (apparently) used in an OA episode a few years back but just wanted say that this was on me, even if it was totally unintentional. I've been randomly pulling from a collection of old MBE exam questions and wanted to be sure to get some torts in there, so just some bad luck on this one. I'm going to try to find a new source to see if we can avoid this in the future, as I don't have any way of knowing every one that has ever been used on the show. Sorry about that!

The correct answer for the duck pond is C because that was the correct answer last time this came up (OA320/OA321).
