Ineffective assistance of council isn’t available on civil side. If this were bar exam land, I’d next write that the client could instead sue the lawyer for any business torts that were committed - breach of contract, the various frauds (law school was a long time ago and I’ve forgotten the details from my Torts class, lol). In the real world, the civil defendant with a bad lawyer is usually out of luck, particularly a guy like trump who has dealt with many lawyers and thus would struggle to prove that Habba mislead him in some fashion. 2024-01-25 21:16:39 +0000 UTCIs it possible that Trump ran with AB as an attorney so he can file an appeal for inadequate counsel? It just seems like she is sooo bad there has to be reason. I suppose Trump doesn’t care and is just using this as a form to raise money from donors?
