OA856: Trump Tries To Delay Carroll Trial (But Not Campaign Rally!) For Funeral
Added 2024-01-15 04:51:32 +0000 UTC
Today, Liz and Andrew document Donald Trump's latest (failed) shenanigans in the E. Jean Carroll defamation trial set to begin in New York on Tuesday. Then, they break down in depth the motion to disappear the Fulton County, GA indictment on the grounds of DA Fani Willis's alleged relationship with special prosecutor Nathan Wade.

I def appreciate the honesty. The truth remains important to most of us. Not wanting the truth is a problem. I also agree with Fani Willis and with Liz. Truth is not devoid of grey area. So the breakdown was brilliant… thank you guys!

Prosecutors are held to a higher standard. The DA has hired a friend who is not experienced in this type of case. It is then alleged that he spent the money recieved on gifts and travel for her. The most negative inference possible is that the DA is choosing to prosecute a wide set of people on a wide ranging case to give her friend the opportunity to make a great deal of money, some of which will then be spent on her. There have been many other cases like this. Judges receiving payments from private prisons comes to mind. It is one of the things I struggle with as someone who is always on the left of criminal justice issues. I can’t just cheer for the prosecutors when I don’t like the defendant. If you can imagine the defendants being from a cause you care about, it will be easier to see why this is a conflict and they should recuse themselves out, or be removed from the case.

It brings up allegations of self enrichment since some of that money could be spent on her, it brings up allegations of letting her boyfriend come in and make a national name for himself even if the case doesn’t merit it (I don’t believe that, but they’ll say it), it would bring up allegations that she’d cover up mistakes he might make. There’s a million things that could be alleged. And she got to stay on that case because Governor Kemp shot down the effort to remove her. I doubt he’d do that if another such effort were undertaken with these facts out there.

Yes, it's a conflict for the DA's office, but how is it a conflict that would affect the trial? There's no problem with either position having some amount of bias because they are prosecuting the case. I don't see how this affects the defendants adversely in any way. I definitely see that it could be cause for termination from the office, but again, that doesn't make the fairness the defendants should expect any different.

It’s a conflict in pretty much any professional space to have a relationship with a subordinate, especially a secret relationship. Prosecutors are supposed to avoid even the appearance of a conflict, and that’s presuming the situation has everybody acting in good faith, which they certainly aren’t here. You can’t separate it from the case, because if she did this, she’ll probably be removed from the case (as will he), and she doesn’t get to pick who takes over. It could very easily be somebody who would dismiss the case. All because she picked somebody she knew she couldn’t. Dumb. Maybe it’s not true, but hard to see that given how long it’s taking to deny it and her weird speech at that church.

So I agree. I could understand the problem with her job, but what does this have to do with the trial? There’s no conflict of interest at all that I can see.

I STILL don’t understand how this relationship affects the trial. I can see maybe if Wade is not competent enough for the position he was hired for that it would be a problem between Fulton county and Willis, but I don’t understand what this has to do with the trial.

@29 I agree with Liz. Really? Fani couldn't say "Sorry Babe, I'd love to work with you but conflict of interest," and not hire him.
I'm not sure I could hope to keep my job after hiring my boyfriend for a cushy contract gig but maybe Georgia is more liberal than Nebraska.
I'm more worried about the media and the liberal Republicans. Uncertainty could reset us to Bush 2.
... it bothers me that I think about animals when I talk about my scared conservative loved ones who may bite me if I don't approach carefully.
