If there are three parties negligent and they’re joint and severally liable, and one is unrecoverable/insolvent/etc., how are the remaining parties that are able to pay decided to split the unpaid burden? In regards to this specific question, since the parties are severally liable, can’t the city also sue the plaintiff to help cover the cost above the 5% that the city owes? Or would the plaintiff not be found to be joint and severally liable with the other parties and the plaintiff’s 10% is treated differently?
