#T3BE 250 - Early Answer for Patrons

Thomas analyzed this exactly right, but went with the wrong answer, (D), instead of the right answer, (C).  It is a statement against interest, but the Confrontation Clause supersedes.  Thomas drops to 131-for-250 (52.4%) and the coin drops to 10-for-25 (40%).

Andrew actually got this wrong, picking (B).

Hmm, if delivering you the combination to the safe is a crime you're alleging, then it still falls under answer C and the Confrontation Clause, right? Which means all kinds of inadmissible hearsay exceptions could happen: "OMG guys I got the code from THE Aaron Rodgers" (excited utterance) "I hate the Packers so much, you all are never going to let me live this down, but..." (statement against interest) "Aaron Rodgers gave me this code..." (dies)

Okay, suppose I'm participating in an Ocean's Eleven style heist and I say to the group, "here's the combination to the safe, which was delivered to me personally by Green Bay quarterback Aaron Rodgers." We get caught and I clam up. If A.R. is prosecuted can this statement be used against him?
