B! Isn’t this one of the dumb “non-hearsay” exclusions ? You can totally impeach your own witness and even though the previous statement was at a grand jury, the witness is on the stand subject to cross examination so it does not matter that the statement is testimonial because there are no confrontation clause issues. And I think you can bring it in for impeachment because you can always use extrinsic evidence to impeach a witness unless it is on a collateral issue.

I always defer to the experts...so if the coin says B, it's B, right? My coin agrees. It also told me that it thinks the prosecutor could re-call the witness and ask them to address the inconsistency and the jury can decide what they want to believe for themselves with all the information presented. I was concerned with the grand jury proceedings being a secret, but my coin said, "Yeah, but the prosecutor is in charge of that, they should be able to ask the judge to make an exception." Washington's face is on my coin. He's smart.
