A recent episode of the Rationally Speaking Podcast featured Originalist Law professor William Baude arguing for why judges should be originalist. Needless to say, it was not a good case and strawman arguments abounded. Andrew is here to give us part 1 of the deep-dive that will set the record straight on why originalism is still bad.

Pretty disturbing to hear Thomas rush to call Watson a creep in a hearsay case. All plaintiffs are being represented by one attorney, so it is pretty easy to make it sound like a pattern of behavior when information is released through a single source. Recently there was a long list of therapists that vouched for Watson’s professionalism. I don’t know who is tell the truth and we probably will never know unless there is audio or video evidence to be presented. Perhaps that is the case, because if a woman is being flown across the country for a private sports massage it would seem like a good idea to record the session for their own protection. Not sure how this one is going to work out, but think it should be handled with caution.
