Catching up on missed episodes a year later, the owner of OceanGate ignored experts, used a composite material against expert advice (composite materials shrink and expand at different rates causing microfractures), they had a history of numerous problems (malfunctions, incompetence, hours upon hours of lost communication), and the OceanGate owner has stated on several occasions "Safety gets in the way of innovation," a very libertarian view. Despite all of that rightwing idiots blamed DEI, because, you know, women and minorities are incompetent; if white men didn't do it, then it was done wrong or aliens did it. Waivers don't protect companies against gross negligence. Which is clearly the case here. Rebecca Watson does a great video analyzing the DEI BS. Behind the Bastards did a great multi-part podcast on OceanGate. Warning! They don't hold back.
