Thank you so much for this forum to ask questions. Here's mine for this week: This week, Lawfare published an article suggesting cautious optimism that the military could/would disobey an unlawful order. Given your unanimous agreement that the presidential immunity ruling lacks constitutional support, I'm curious about the following: 1) What is the argument that district and appellate courts should comply with this ruling, despite its perceived lack of constitutional grounding? Wouldn't lower court judges, like yourselves, view the ruling as unconstitutional and unworkable? 2) What forms of civil disobedience could lower court judges engage in to undermine or disregard the ruling? 3) Wouldn't a widespread refusal to comply with this ruling create immense pressure on the Supreme Court to reconsider or walk back their decision? Can you draw parallels to historical instances like Furman v. Georgia, where significant backlash led to changes in the Court's stance? To me, this ruling necessitates a constitutional crisis, but I'm not a lawyer and can easily be talked down by the fantastic people at Lawfare. I'd love to see an article on this topic; thank you so much for making difficult legal concepts understandable!
