Your Early Premiere is here! Right up against my final promised deadline which I was so sure would be easy to hit! I was right that as a trial it would be easier to animate, but I underestimated how much the sheer length of this one would hold me up, so thanks for your patience 🙂

It’s a bit of a different case than usual, which isn’t a bad thing in my mind. Amazing how such a short incident can contain so much to debate and talk about.

I just finished watching the sentencing hearing, and Miu got 20 years for Isaac’s killing. The sentences for the other stabbings were between 5-6 years and will run concurrent with the 20 year sentence. Nicolae Miu is an absolute shadow of his former self. I think his behavior was reprehensible, but watching him give his statement during the hearing left me feeling sorry for him. He is truly a broken man. What a tragedy. Thank you for your always exceptional work, Matt!

Regarding the ‘was he surrounded’ debate, I have to side with the defense. I’d have felt surrounded when the stabbings began, and I’m only watching this from my phone. I bet it was very disorienting in the river, and he could very easily feel as if he had no escape. Then again, if he’d have seen the situation worsening even a few seconds earlier, there was ample room to escape.

I ran to the comments to make sure I’m not the only one feeling a bit of sympathy for a murderer. Watching them pushing Nic in the water and take turns hitting/pushing him was so hard to watch. Obviously, RIP to the boy he killed, he didn’t deserve to DIE… but damn, this is why if I see a group of teenagers, I walk the other way 😧😧😧

Hey Matt that was great, I think it was it was great to show the whole thing uninterrupted, as on first viewing I didn't see any of the stabbings. Then when you went through all the stabbings I was shocked to see that there was so many. I actually find it quite hard to watch when I can make them out and it was so and I just find it personally hard to see how this guy had any regard for life.

The teens most certainly caused the severity of his reaction. Whether or not he was justified in the stabbing is up to debate but he was mentally unstable and they were fucking with him… don’t do that, just get away from those types of people.

The biggest take away from this case is that you get the fuck away from strange or weird people. Don’t confront them, don’t shove them, don’t talk to them, and definitely don’t aggravate them. Why you would do any of those things is beyond me, yes they were drunk but if they would’ve left they would never have gotten stabbed or been able to react faster in a less chaotic situation. Both sides fucked up but he’s more fucked up for stabbing them. I can see how he may have been scared when he was pushed but after that his actions were unjustified. This guy is obviously mentally unstable, a lot of people are, don’t fuck with them. If they come at you then you defend yourself but stop there. Save yourself and not antagonize others.

Matt Orchard, the only case that really pissed me off as much as this Miu case was the Daniel Holtzclaw case. This is also the only other video you’ve done since that surpassed a time length of 2-hours. I see this kinda like the Michael Dunn case but a bit different. I’m not at all happy about Jawahn essentially inciting a riot against someone he knows nothing about. This iPhone footage was very grueling to watch because of all the chaos. It’s taken me a while to make this comment because after watching this I watched some of the testimonies and it’s just frustrating to see liars on both sides of the fence. But the fact remains, Miu is a Romanian concentration camp survivor who has also undergone a quadruple bypass that is looking for a phone, might not have his own phone on hand thus most likely couldn’t call 911. Whether or not Miu was right or wrong to do what he did, the reality is that someone like him could be holding heat. It’s very much like the rapper Prodigy of Mobb Deep who resided in the middle of gang wars and living with sickle cell who always carried a gat to defend himself. Whether the judgement is right or wrong the fact is that there are people in this world that aren’t messing around and this group of teens clearly had no idea who they were messing with and that they might get stabbed or shot. All of this could have been avoided with respect, even if just a little bit. And you know what? No matter how much time Miu does, it will never bring Issac back which would have never happened had Jawahn kept his big mouth shut instead of trying to make viral videos (with reactions most likely for World Star Hip-Hop) and trying to be cute for his friends by putting others down. There were no winners in this!

This whole case left me so conflicted and confused. It definitely looked like the guys initiated the conflict by the bullying, but in the video where he approaches the group in the beginning - where he claimed that he stumbled - it kinda looks like he’s maybe possibly initiating a conflict. Also the way he talked to the police about the “raper” allegations was way too lightly for someone who was very bothered about the comments. The fact that we don’t know if he hit the girl first or not makes it nearly impossible to know who escalated the conflict. I still don’t know if he stabbed around out of fear or for revenge. I definitely do not envy the folks in the jury. I guess I’ll just rewatch it 8 more times

I've browsed other videos about this case and none of them do much more than play the interview in full with little to no research or commentary, which is as boring as it is annoying. I did get a bit distracted by the judge looking like the defense attorney but with hair (or maybe it's just me).

They weren't making a formal report, they were calling him names. Picking on him and bullying him definitely, which maybe justifies Nic getting a little mad and grabbing at their tubes. Which escalates into a fight, which escalates into stabbing, some of which I don't think Nic is strictly culpable for, some of which is clearly was.

It just means someone who's bullish on civil rights. Like if Miu made indications he was interested in speaking to a lawyer, but was sort of guided away from it, there are certain people who'd be pissed that was ruled within bounds. I'm kind of a bleeding heart on things like that - though the state as probably right that Lt Hart's tactics were legally within bounds.

Was the word "probative" or "libertarian"? The perspective thing is just Wisconsin's approach to self defense cases, it wasn't a decision specifically made for this case. It's funny, because I would actually think "from the defendant's perspective" should be the obvious standard as opposed to "third party perspective." Bear in mind, it's not simply "Well if you think Nic thought he was in danger, that's fine" It's "would a person of reasonable prudence, put in Nic's shoes, feel in danger." So if he did feel his life was in danger, but reasonably speaking, from his perspective, he shouldn't have, you can still convict.

SPOILERS Sentencing in the states honestly seems extremely stiff in general to me. I agree 20, 30, 60, 97 or whatever amount of years it seems he's got coming to him is too much for the circumstances.

Hey Matt... what in the world was the word you used at 1:15:36??? This case is THE definition of "minutia". 3 minutes of video capturing, not directly, every aspect of the case, yet you can scrutinize every single frame. You said it perfectly when no one argues against the stabbings, but instead the intent of every instance. Additionally, do you know why the jury was told to view the self defense through Miu's experience? I had thought that self defense was objective in the sense that it doesnt matter what you think it justifiable, there is a definite line where it becomes justifiable. Think the case of Michael Dunn. He thought, though wrongfully, that his life was in danger, but the case was presented with the FACTS that he should not/had no right to use deadly force.

Great video! I had never heard of this case before. I do have one technical suggestion - toward the beginning when you play the evidence clip in its entirety, and then break it down with voiceover in between clips, the audio of the witness's video is a bit loud compared to your voiceover. I felt like I had to keep turning the volume down when the video clips were playing and then back up when you were talking. It's a sonically abrasive video to begin with, and especially since you add subtitles for the important/intelligible parts, I think it would be wise to turn the audio levels down when the video clips are playing with sound.

I was eluding towards the act of the instigating comments alone.. I’d still consider those “raper” comments coming from a teenager boys mouth as a sign of immaturity which is pretty common for that age group. Agree to disagree about your viewpoint on violence in this situation.. I don’t think most expected a man in swimming trunks to have a 4inch blade on him. Reread “got carried away”.

Just a tragic case. Teenage boys doing teenage boys things with the power in numbers mindset, got carried away, and unfortunately led to an escalation no one could have ever seen coming. When I saw the 2hr run time, i was worried it was going to be a lot of interrogation footage which can drag on, but i appreciate you making this into more of a documentary with detailed analysis of a lot of moving parts from a 3 minute clip of evidence. Really, really regretable chain of events... I do think Nic's missed many, many opportunities to retreat. He also appeared to hide his knife, keeping it low. Surprised with some of the outcomes, as one of the non-fatally attacked persons was not like the others.

Awesome video as always! One odd thing I've noticed after watching the video of the incident is that you can clearly see that loads of people seem to have camera phones out and are filming the whole thing unfold. Surely there's more footage of this stabbing out there

Wow. I remember watching some of the court videos and the rafting video but I'd never watched the interrogation video of Mu. While it shows him in a bad light, i don't feel he deserved the sentence he ultimately got

This isn't evidence, but as soon as we get to stabs 2, I think Nic's body language just doesn't track for someone in fear for their life acting in self defence. He's got the posture of someone who is mad, but not afraid. He's not taking any kind of defensive stance, not really guarding himself from potential attacks, just sticking the knife in whoever comes closest.
