Creator Commentary: The Only One Who Deserved to Stay: The Case of David Bain [+ UPDATE]

UPDATE: The next vid “Everything Happened So Fast: The Apple River Stabbing” is not long away but has been slightly delayed. I moved homes and complications derailed production more than I anticipated. Plus some of the trial footage took a long time to whittle down to the point I thought it was digestible and well paced.

Good news is, we’re looking alright now. I’m promising 100% 15th of July just to be safe, but given what I’ve got left in front of me I think it could be anywhere between the 10th-15th. It should be a big one too! Probably around 2 hours. 

Another Commentary here in the meantime to tie you over, and probably a personal favorite at least from the earlyish days. I hope you enjoy reliving it with me 🙂

I feel like the horror of this case is really lost by the lack of conceivable motive. A truly terrible crime that has been so focused on the specifics of the crime and the timeline that the lives lost is rarely discussed. Great video as always Matt

It was 1997/1998 that Ben and Olivia went missing in the Marlborough Sounds. Our family was actually staying out in Waikawa Bay which was only an hour away from where that happened. The series Doubt has alot of reenacment footage including witnesses etc then there's Ian Walshes book which makes points of Watsons guilt but yet .. no bodies and Watson fid not own the ketch reported by various witnesses.....

Black hands was a brilliant podcast aswell as the series. It certainly showed aspects of David Bain that were creepy and convincing of his guilt.

I found this channel after reading Black Hands. And I became a fan with how you covered the Bain house being burned down. I thought it about it when the Idaho 4 house was torn down. Fwiw, I think the conclusion David did it is supported by three impressive sources. The first is Black Hands—book and podcast—by Martin van Beynen. The other two are reports (available online) by former NZ Justice Robert Fisher and retired Australian Justice Ian Callinan finding David did not prove he was wrongfully convicted. By contrast, the pro-David report of former Canadian Justice Ian Binnie is weak—as you note in your clip of him at the 47-minute mark of this video. Ultimately, David was reimbursed the cost of pressing his claim—but denied compensation because he failed to prove his innocence.

I also think he probably did it, but I don't think the "beyond a reasonable doubt" threshold is met. There is, in my mind at least, a decent shot it really wasn't David.

Oh my god your mum was a judge? Have you ever interviewed her? So cool! No wonder you're so comfortable with legal and court jargon. I worked with (administrative) lawyers here in Australia for nearly two decades and listening to them discuss the finer points of tribunals was the highlight of my work day. I don't have the intellectual rigour to actually BE a lawyer, but law-adjacent work was a joy.

new here, late to the video, but i wanted to comment on the emergency services call. it’s a yanny laurel situation, but i heard initially, and can still hear if i’m listening for it, “i cant- i cant breathe- i cant..” but i also can hear “i shot the prick.” honestly, the former is more compelling to me as a subjective point against david. he’s a bad actor. especially when combined with the whining and his ability to repeat critical information clearly and calmly when he’s overdone it and the operator can’t understand the phone number. i’m pretty sure it’s clear to the operator you can’t breathe david, you’re hyperventilating straight into the mic!!! anyway, listening through the catalogue and thought i’d put in my two cents here edit: negative acting points for his complete inability to be at all solemn upon acquittal for the mass murder of his entire family. just grinning ear to ear, which only falters when the reporter suggests he should be tired, at the least.

Tiny note about the use of the word "shattered" which confused you. Here in the UK shattered is pretty universally used to mean tired or exhausted. A lot like "knackered". Here where I live (South Wales) shattered is probably more common actually. Worth pointing out because I am aware that there is kind of a loose soup of lingusitic influences between the UK, Australia, and New Zealand so thats what I read it as.

It's not the same, but it's close enough that I understand where you're coming from with the NZ rugby thing; Finns and ice hockey. The national team isn't venerated to the same extent, and it's not a league team, it's only for tournaments like the annual world championships or the winter olympics, however, we definitely have that small country insecurity and a need to fistpump whenever we're mentioned, point out individuals who put us on the map, and regularly being on the podium in hockey makes even a lot of people who don't give a shit about the sport otherwise tune in and scream at the telly.

Something that is pure conjecture but I feel quite strongly about is that the order in which the family was killed, in my view, makes David so much more likely to be responsible. The first person to die was Margaret, and this was very much the 'mercy' shot. Only the first person could be more or less guaranteed to not wake up for it - Stephen and Arawa were awake, probably from the sound of gunfire, Laniet may have woken but probably died in her sleep. The first person to be killed was, you would think, the person the killer loved the most (if you can call this love), or hated the least. If Robin is the culprit his motive would've been Margeret's pathological control over the family and her alienation of him as a father. It would've been a real fuck you, taking everything from her, the deepest kind of hatred. David always loved his mother the most and was her favourite. If anything his motive was that the pipedream of the family sanctuary was slipping away and he was losing his Mum and role of quasi head of household - some real Oedipus type shit. I would expect Margaret to be the last had Robin been the killer. He would've wanted her to know what he had done before it was all over. David wouldn't have been able to deal with the possiblity of his mother seeing him for what he was, and planned accordingly to make sure it didn't happen. He was hoping nobody would wake up, but took no risks that his Mum did. Poor poor Arawa and Stephen. The last thing they saw was their brother with a gun. The stuff of absolute nightmares. It genuinely bothers me that David is free to go about his life without having confessed his guilt, which he would had have to do had he lost his second trial and released on parole.

I’ve watched this video dozens and dozens of time cuz like you said it really did feel like a next big step in all your greatest videos, I always thought David didn’t do it from purely watching your video again and again! Hey Matt, please do more NZ cases. I just came back from 4 months in NZ and would love for you to cover the case you mentioned here. Or the older Aramoana one (there you got footage in form of a movie, but maybe not possible to find an angle on how to cover the case? Mass murder are something different). The recent case with the boy in Gore would be perfectly up your alley. I would like to see if you approach it differently compared with the current pod that is going on. BTW I had to drive by Every Street on my trip. Just had to. Quick glance, new house there of course, but didn't stay to oogle like some creepier true crime fans would probably do... 😅 Keep up the good work.

“Shattered” is being used to mean “exhausted” in the quote you were commenting on. It’s more of an Australian term which is why you probably haven’t heard it too often.
