One of the big questions on the temple recommend interview is about supporting and sustaining the leadership of the church and it names the prophet, his counselors, and the 12 apostles. And then in the temple, there are 4 covenants you make and one of them has "no evil speaking of the lord's annointed" in it. While not everyone gets excommunicated for speaking out against the church leadership -- it depends on your local congregation leader (bishop and stake president). The fact that Mr Atheist hasn't been excommunicated yet is irrelevant.
