It’s hard to justify that he was mentally impaired prior to the break ins. He was mentally competent to know that when the kids were working at his place, he would barely be around due to the bad image of such thing. I’m sure the break in’s made him unhinged. He clearly became paranoid once the break in’s began. Not to mention he worked for the State Department so he has even more incentive to own a gun. And yes, there are definitely better ways to handle something like this... but this is also something that almost ever happens. I’ve never heard of anything like it prior to the video.

There was an 8-10 minute gap between shooting Nicholas Brady and Haile Kifer. Smith did not call law enforcement, he waited in his basement. He had four security cameras outside of his home. If my directionally challenged sense is correct, the monitor for those cameras was in the same room that he put Brady's body. I've not seen anything stating if he was watching those cameras between the killings. Smith told law enforcement that he waited until the next day to ask his friend/neighbour Bill Anderson because he didn't want to spoil Thanksgiving for law enforcement AND that he was sure that there was another accomplice that was going to come looking for Brady and Kifer. What was his plan for that fictional accomplice? My guess is the same plan he enacted with Brady and Kifer. Smith waited an afternoon, evening, night, and most of a morning before he asked Bill Anderson to call a lawyer and law enforcement.

I am in the UK, we don't have the same gun laws etc so I am just going to say what my take is on what I just watched... I think the guy probably had mental health issues for a while before .... The robberies and lack of police help pushed him over the edge, those recordings and ramblings sounded evil.... But I do believe he knew what he was doing and he lured them in by moving his car.... I think he needs locking up but maybe a full psychological evaluation.... Just a terrible story really , no winners here, thanks again Mike really enjoyed this one 😊

Angry white man. There are so many of them in this country. It's not that difficult to safe guard your home from break in. He wanted to murder those kids, that's all it comes down to. Thought out, planned out, carried out according to plan. 1st degree murder. Glad the justice system worked in this case. Thank you for the video.

I saw this case years ago, and was very curious about more information. Good content Mike! I believe in everyone having their right to defend themselves. This case was served right though, since he didn't just defend himself. He became an executioner.

I'm just glad MN (where I live) didn't let the guy get away with it. It was his home, but he setup an ambush. MN also has a "duty to retreat" law I don't know how that plays into homes, but in public you have to try to get away safely, shooting is a last resort. Lastly, Smith moved Nicholas's body so when Hailey was looking for him she had no idea he had been shot.

I vaguely remember the coverage of this story on the news. It was infuriating. Obviously, breaking and entering is illegal and they were in the wrong, but that isn't a capital offense. I remember Sean Hannity justifying this and saying that they had broken in and the murder (murder because he didn't need to fucking kill them!) had been justified. If he truly wanted to plead the castle doctrine, then he should have just wounded them, he would have had a lot more support besides fucking Hannity. Either way, this guy needs to rot in prison. When he knew they were in the house, he could have just called the police and if he had them on tape he could have pressed charges and no lives could have been lost. The Castle Doctrine does not cover premeditation and ending a life after the threat is gone. The people worrying about not being able to "defend themselves in their own home" don't have to worry as long as they don't decide to execute someone after the threat is gone and call the authorities because if he had actually done that after wounding them, he would have been able to get off with the castle doctrine easily. Also, it doesn't matter what their priors were. breaking and entering and burgling is not a capital offense, therefore it should not be treated as one.

This case isn't as legally or morally ambiguous as everyone wants to make it seem. He murdered them, full stop. None of the extenuating circumstances ultimately matter.

Regardless of why the victims were in the house, their prior records, or Smith's previous burglaries, at the point he was no longer at risk he should have stopped. They would have gone to jail and he would have been vindicated. He said it himself, he wanted them dead, he wasn't just protecting himself - it was revenge. In the UK the question that has to be asked if someone tries to argue they have used appropriate force in a situation is was the force reasonable, proportionate and necessary? Smith's actions were none of these. The victims were in the wrong, but Smith committed a worse offence and in my opinion the jury got it right.

If he had truly been repeatedly harassed by break-ins, especially after his previous generosity, I would think it would be a possibility that he had slipped into psychosis. He did not seem to be living in the same reality as before, and, most tellingly, he no longer saw his harassers as human. They were "vermin" and by logic in his twisted mind he became the exterminator. I know he acted in a premeditated fashion, but I still think all of his actions could be the result of this break with "reality" brought on, also, by his apparent social isolation. Like an earlier commenter noted - he had no other place to be on Thanksgiving than sitting in the dark in his basement, obsessing and ruminating on his victimization by these beings who were the equivalent of rabid rats, in his understanding. It's a terrible pity what happened, for all involved. On another note, considering that he installed security systems in embassies for the State Department, why do you think it didn't occur to him to install a similarly secure system in his home? Even a run-of-the-mill security system can alert police when a break-in occurs. Certainly such an alert plus his already extensive video & audio would have been enough to build a strong case?

The audio was absolutely chilling.... I wonder if that was the true “nail in the coffin” for him. I also wonder about his mental state - although it wouldn’t excuse the executions, it would be worth a shot to see the progression of it all. While this was a rather extreme version, I do think the Castle doctrine is a bit dubious. . . What i May consider “no longer a threat” may be different as to what the next person may consider. As a Canadian, yes we have some gun control laws, like no concealed weapons, wait times, licences etc...BUT, let's just say I'm formerly from the Texas of Canada, Alberta..every farmer has a gun, legal or not. You have to. We don't commit mass shootings, we don't take our guns to church or wherever, and we don't shoot people, usually, for no reason. Sure we've had a few psychos, like those two boys from Port Alberni, and a school shooting 30 years ago, but not like the US. We are civilized and responsible gun owners, it's a mindset. Our shootings are almost always gang related. Buddy shooting two kids who break in, just would not happen here, even if the homeowner owned a gun. Yes we would confront an intruder, but shooting them, very unlikely unless the intruder didn't get the message when they found out you had a gun. I agree with you on all the rest of your comments though. Definitely some mental illness there.

I raised my girls on a farm alone. Three times in 15 yrs I pointed my gun at trespassers on the property, once two men in my driveway. When I squarely and easily shot out there back passenger window after I told them to leave with my rifle, you can bet they hit reverse and high tailed it out. Once and only once did I shoot at poachers directly, after they shot my way. I missed, I think because they got the message and tore off. I guarantee if anyone would have ever entered my house, I'll give you only one chance to back off. I see his side BUT he murdered them, period. The threat was gone.

Great video mike this was very interesting one here. I believe in guns for defense I also carry concealed but yea he killed those kids. Carried it to far. He lured them in a way/entrapped them then laid in wait BUT I feel bad for him being broke into all those times. He went about it all wrong. IMHO

I carry a gun with me everyday, and everywhere I go. I don’t carry it to kill, I carry it so I don’t get killed. I can not defend myself if someone wanted to rob me, or for some unknown reason wanted to hurt me. I have a medical condition that has affected three of my four limbs. I feel this guys pain at not being helped, but taking a life absolutely sucks. As for thieves, you get what you get.

I have seen this case looked at before but it is a good one. In regards to guns there are purposes for them where they can be used to right a wrong but also in saying that I am for gun control. Personally if I needed a firearm for a cause I deemed good I would get it illegally. Wrap your head around that one. LOL! Anyway ... This guy is a psycho & definitely deserves his charges & sentence. Defending your home is one thing but his actions were disgusting. Even if he'd fired a couple of warning shots the kids probably would've ran away. He was hell bent on killing whoever was breaking into his house & planned out exactly how he was going to achieve it. That is not normal thinking. Everyone has the right to defend their homes but unfortunately he was on a mission to do more than just 'defend'. The kids were definitely doing the wrong thing but they didn't deserve to die because of it. Many thanks & much appreciation for all your hard work Mike 💕

I’m all for the castle doctrine but he set them up by moving his truck. He shot them multiple times. His was little more than a revenge murder. He is where he belonged. It’s too bad the thieves were not caught before being killed. Changing their behavior could have kept them alive too but in the end, though the thieves were in the wrong and shooting them MIGHT have been excusable....once they were down and were no longer a threat, it became murder. Placing the gun under her chin and firing.....I can’t fathom how on earth castle doctrine could be applied. Castle doctrine means you can protect your home. It’s not a license to carry out executions inside your home. I am all for gun ownership (though I don’t own one personally) but with ownership comes responsibility. He seemed to have forgotten that part. Somehow, the man became paranoid and unhinged. Glad it was upper to first degree murder.

He definitely shouldn't have executed those poor kids in my opinion. He seems mentally impaired and shouldn't have even had access to a gun but its 'Merica. Nothing to be done I suppose. I'm just glad I live in Scotland where guns were banned back in 1996. There are better ways to handle a situation like this.

Smith, seemingly unapologetically, shows himself to be a sinister, macabre, malevolent individual who more or less *invited* these high risk kids into his apparently empty, "oh-what-an-easy-target" residence purely for the purpose of basically executing whoever was mad, bad or sad enough to break in Listening to the recording, not only did he sound righteous and proud at what transpired, he sounded as though he ENJOYED it; a bona fide preditor, hunting in his own abode. On a TOTALLY different note, great video, Mike - thank you for such excellent content, as ever.

Very sad situation....it hard for me to take sides on this one...yes the way he went about trapping those kids and then executing them was wrong...i believe he was driven to it but that doesnt make it right...and those kids were probably the ones that drove him to it...i feel for all involved here...we are human and we screw up it just sux that this screw up cost as much as it did

Yeah- you can’t help but feel some degree of sympathy for the killer in this case. However, for me, it comes down to whether death is a proportionate penalty for burglary, and I would say not. He didn’t give those kids a chance & there was zero evidence of her laughing at him- sounded more like she was screaming to me- he seemed to reserve most of his nastiness for the girl, not really sure why. I personally think justice was done here & he richly deserves to be in jail.

I agree this is a very tricky one. I understand why he’s so angry about the break-ins, i would be too, but he should have gotten the police involved sooner instead of taking the matter into his owns hands like, quite frankly, a psycho. These kids obviously should have known better and it’s a very serious thing to break into someone’s home, but the way in which this played out isn’t right. I don’t think it was wrong to shoot the first time to remove the threat. I do not believe it was right to execute them in cold blood especially because they’re kids and we all know kids do some really dumb things before they wise up. Unfortunate all around. Great video that made my lunch break so much better, thanks Mike 👍🏼❤️

That recording was both sickening and enraging !!! I do not agree with any of the shots fires although the law would justify the initial shots as self defense but there is no question he wanted to kill them and took pleasure in doing so . Omg he is vile !! They should have put him UNDER the jail
