Chris Perkins, works for wotc, ran a game with Penny Arcade for a long time. Chris allowed inspiration to be held or passed to other players by players not by characters so i would have sided with the player.

Regarding the killer familiar, I think Murph's examples don't fit the situation. The Warlock controls his familiar and directs it using a bonus action on his turn. So the question isn't "if the familiar goes rogue and kills someone would you punish the warlock or the familiar?", the right question would be "if the warlock orders his familiar to kill someone, would you punish the warlock or the familiar?"
The whole point of this case is that the familiar isn't acting independently. It is a summoned spirit which is magically bound to its master and acts based on its master's will. It isn't "going rogue" when it kills for the warlock in battle. It is serving as a weapon under the warlock's direct control.
I would rule differently if it was an allied animal, under the direction of a druid or something, but familiars are an extension of the caster. They do not have the freedom to act independently. I would not consider them to be responsible for a murder. They are a weapon. The warlock is the killer.

For one rare time, I disagree with Murph RE: the familiar not counting as a kill for the Warlock. I was on his side, until his reasoning could be used against him. "When the familiar dies, does the Warlock die? No!"... If the Warlock used a weapon to kill the barbarian, it would count as a kill for the Warlock, but the Warlock doesn't die if the weapon is destroyed.
Also, using the bonus action to make his Find Familiar spell do damage isn't much different than using a bonus action to make the Heat Metal spell do damage. It's part of the spell... and the spell that the Warlock cast is what did the killing.

I propose entering the "Case of the Apes and the Hole" to the Supreme Crit Justices, May it Please the Court.
I am the DM of a couple of campaigns taking place in a world called Ardicil. Recently, to ring in the New Year, and mainly to vent my frustration at certain players, we played Tomb of Horrors. They went through multiple traps and many rooms with ease but eventually came to a room with three Chests. After opening a few chests and doing the required tasks/combat, they opened the chest that summons a Giant Skeleton. After a round of combat, our Firbolg Druid chose to Conjure Animals, and summoned four CR 1/2 Apes to the room which swiftly stole the bones of the Giant Skeleton and beat the hell out of it. Upon realizing the room was complete, the Druid and Party attempted to leave, the caveat, the only exit was a small crawlspace which I estimated to be a 3 foot diameter, but on further review found to be a 3 foot by 3 foot square exit.
I posited that the Apes would be too wide at the shoulders to fit through the hole, which was subsequently met with immediate backlash from >all< of my players, stating that there was no way that an Ape WOULDN'T be able to fit through that hole. I proposed that after working at a Zoo for a while and specifically working near Western Lowland Gorillas, I KNEW that they wouldn't fit. My players then proceeded to bring up the point that our Druid is a Firbolg, and is thus 8 feet tall, and wouldn't be able to fit in the crawlspace by my logic. I suggested that a humanoid build is different from a Great Ape build and that Firbolgs, being humanoid, could crawl on their arms and legs to fit through. That did not help my case as now I would have to backtrack and either remove the Druid from the room or leave him stranded in there...
After a lengthy argument, my biology major mind took over, and said "Screw it" and chose to do the rapid research instead and had them roll on a custom table, to figure out what type of "Great Ape" they conjured, even though the spell allows me, the DM to pick any CR 1/2 beast.
(For those curious, they rolled and got a Bonobo, a relative of a Chimpanzee).
The Bonobos fit through the hole, but I question "Did I get wronged by the players getting to roll for a Bonobo?" or am I just a salty DM who had the belief that the creature named "Ape" references a Gorilla. And on the topic of the Firbolg, could a Firbolg technically fit through a 3 foot hole? Or am I being unreasonable there as well.
In the end, we came to an agreement, one that was Biologically true to what an "Ape" is, and the game kept moving, but this is just to prove a point to my bastard players (I'm talking to you Ismat, Jinn and all the others who listen). In essence, my players hate me lovingly and I hate them just as lovingly, sometimes without the love, and all is right in the world of Dungeons and Dragons. ~ Sincerely, Alex / Perigast.

I play in a large group and our rule is if you have to step away during a fight you get slotted in the next turn once youβre back. We have a pretty strict time slot for our games so it helps keep battles moving without screwing people out of their turn for being humans.

Er, to clarify, to rule out someone extending theirs to someone else when their character is unconscious. Based on a VERY stringent reading you could argue that it would require the player receiving the inspo doing something to warrant it, but imo that is an unreasonably harsh take.

I would like to concur with two sentiments from my fellow commenters: firstly, I think the DM in the Inspiration case is wrong and Inspiration is a tool for encouraging good role-playing and fun games and not a character action, and it is not supported to rule out someone extending theirs to another player. Objection! Inspiration does not require an action on the part of the character but instead is a player driven act that acts on a meta level. A character being unconscious does not impede the ability for the character's player to "reward" another player with advantage on a roll per the use of inspiration.

The language of water walk says that you ascent underwater at a rate of 60ft per round. This doesn't make water a solid object, just that it push you back, you can hold yourself underwater the same you could hold yourself up on a ledge.

I actually agree with the DM unless they did the whole saving throw thing and still didnβt give up the info. I donβt think the plaintiff went into that much detail thoughz.
Edit: I missed the part where they said that they were explicitly asking them about the cult when they cast the spell. I then totally agree that the cult would be at the forefront of the cultists mind at that point.

Also, what Murph said about Detect Thoughts is basically how the spell is written. It's an initial save against surface thoughts, and if you want to pry deeper the creature has to make a save against getting deeper thoughts, and knows you cast it. So there are tools to divert how much info they get from Detect Thoughts if they pass their saves.

small logical issue with the legolas defence: Legolas uses his own innate ability to walk On the snow. However, in the case of this player, they have a magical spell cast on them that causes their body to be pushed out of water. This spell is a set, concrete effect, the player cannot adjust it to suit their needs in the moment, as Legolas can his agility. With this in mind, i dont believe the DM is as completely in the wrong as he is made out to be. I do however, believe he is a bit of a hardass, and probably kind of un-fun
