One of the things NCIS does is point the spotlight at Recurring Characters, like Niki Jardine, and flesh them out more. I think her brother is just in a coma, like Gibbs was in 04x23/24 Hiatus. Gibbs was only on a ventilator and that was just for a few days after he got blown up. Her brother has had what, a year or two, to recover from any injury he suffered. He probably just hasn't woken up from his coma.
