The cop who died was unaware that Jeanne (Tony’s girlfriend) was seeing someone else while he was trying to get her back. Later, while he is on the stakeout, Jeanne calls Tony to inform him that she finally told her ex about their relationship. This leads to the email from her ex (the cop) at the end, where he acknowledge it and says he'll stop pursuing her. In short niether of them knew that the other knew Jeanne. Hope that clears it up.
