Whitebeard has already declared war; he's going to be attacking no matter what. All that's going to happen now if they set Ace free is that Whitebeards going to have one more powerhouse on his side for his assault.

I think you commented on why his arms look messed up. He's actually a member of the long-arm tribe which they just mentioned is the rival clan of the people on the island Brook landed on. They have an extra joint in their arm, so their arms are super long.
