You can't practice law without a valid law license. The reason Hank asked that is Saul is untrustworthy huckster, and as it turns out he got his law degree from a correspondence school, not very well respected like being a Harvard graduate or something. Hank was implying (quite correctly) that he got his degree somewhere a little less than prestigious as a lot of lawyers would have.
