MFS News: Terms and Conditions

Hi all! Apologies for the slightly late post; Easter Weekend holiday and all... That said, this is the full list of Terms and Conditions regarding MFS Commissions, both public and private - though there are little extra bits regarding Patreon, so be sure to check it out. I know it's weird to see such legal-ish stuff, but I just wish to make this all clear. Now without further ado...

MFS COMMISSIONS: TERMS AND CONDITIONS

[EDIT 13/04/2022: Updated again, 'cuz I realise that some stuff has been changed again. Section 6 has been changed quite a lot there, especially regarding the discounts!]

 Pre-amble: This document aims to provide the terms  and conditions of working with MostlyFunStuff Arts in the exchange of  information and creation of commission artworks. It aims to provide this  information in a simple and readable manner. By reading this and asking  for a paid artwork, you agree to these terms and conditions. You will  be notified if there are any changes to this document.

1. Terms used in this Document:

1.1 - "I" and "me" and "my" refers to MostlyFunStuff, the sole trader owner of MostlyFunStuff Arts and the MFS Patreon.

1.2 - "You" and "your" refers to yourself as the customer.

1.3 - "We" refers to myself and yourself in the exchange of information.

1.4 - "Commission" refers to a paid request to create a personalised artwork.

1.5 - "DeviantArt" refers to the website made for sharing artworks.

1.6 - "Patreon" refers to the website where artists and creators can be supported by "Patrons", who can donate any amount they wish, and receive rewards.

1.7 - "Discord" refers to the free voice and text chat application. 

2. Requirements before Commissioning

2.1 - A PayPal account and an email address is required before contacting me with commission information. 

2.2 - The PayPal account is required to send funds. 

2.3 - The email address is required for me to send an invoice to you at completion of the commission work.

2.4 - The email address can also be used for me to send the completed commission work. Other sources are available such as sta.sh on DeviantArt, as well as sending the files via Discord.

3. Types of Commissions

3.1 - There are five types of commissions, followed by its code:

• 1. Sketch [SKT] - Rough sketch-style works with no line-work or color
• 2. Lineart [LNS] - Completed line-work, ready for color
• 3. Flat Color [CLR_FLAT]- Flat color works with no shading
• 4. Shading [CLR_SHD] - Color works with basic shading and highlights
• 5. Extra Shading [CLR+] - Color works with all shading and highlights (eg. soft shading and highlights)

3.2 Each has their own price rate, as noted 4. Information, located on the front page of my deviantART page or you can ask me directly and I can provide you the current rates.

4. MFS Commissions Section

4.1 - Pricing information is located on the front page of my deviantART page: mostlyfunstuff.deviantart.com, under the heading "MFS Commissions". It is located just below the About MostlyFunstuff section. Important: To see this, you may have to use the Eclipse site theme, as this may not show up on the old site's theme. 

4.2 - This contains  the details of the pricing for each commission type, including base  rates and extras. You can also ask me directly and I can provide you the  current rates. 

4.2 - This also shows whether I am open or closed for commissions.

4.3  - If you do not wish your username be shown on the  description of the posted commission itself, please indicate beforehand  and your name will be shown as ANONYMOUS. 

5. The Process and Contact

5.1 - During the commission process, there are four distinct stages. Naturally, sketches and line-art stop at their respective stages.

• 1. Information
• 2. Sketching
• 3. Lining
• 4. Coloring

5.2 - I will be in contact with you during every stage of the commission process as it updates. 

5.3 - All WIPs shown during this process are compressed and reduced size JPGS. 

5.4 - Contact will be made via your choice of deviantART notes, email or Discord DM [Or Patreon Message].

5.5  - To ensure a quick and smooth-going process, it is highly recommended  that you choose your most commonly used contact that you can respond to  as soon as possible. Please inform me of your choice well in advance.

5.6  - On completion of the work, a full lossless PNG is provided, along  with the invoice, a PayPal invoice sent to your provided email. You may pay it through the invoice itself, but there are avenues in case you do  not wish to use the invoice. You must however, keep the invoice for your records.

6. Pricing and Payments

6.1  - During the first stage of the commission (see 5.1), the prices, according to the fixed rates on The List is referred to, and can help  inform your decision on which type of commission to buy. You can also  ask me for this information.

6.2 - Upon completion of the work, an  invoice will be sent to your provided email. As it is a PayPal invoice,  you can choose to pay the invoice through there.

6.3 - [For MostlyFunstuff Patrons pledging $5 or more]: There is a 10% discount for Patrons in this tier: which amounts to 10% off  the total cost of the commissions. Please inform me if you are currently a paying $5 Tier, e.g, by providing your Patreon username for me to check.

6.4 - [For MostlyFunstuff Patrons pledging $10 or more]: There is a 15% discount for Patrons in this tier: which amounts to 15% off  the total cost of the commissions. Please inform me if you are currently a paying $10 Tier, e.g, by providing your Patreon username for me to check.

6.5 - [For MostlyFunstuff Patrons pledging $10 or more]:  To be eligible for this discount, you must have actually paid on a pledge for the MFS Patreon in the past. A.K.A, your lifetime pledge so far must be more than zero.

6.6 - [For MostlyFunstuff Patrons pledging $5, $10 or more]: For any discount to apply, You must be an active Patron.

6.7 - [For MostlyFunstuff Patrons pledging $5, $10 or more]: The 10% and 15% Discounts are exclusive, and do not stack with each other.

7. Paying on Time

7.1  - I do not provide money credit on Commission Work - i.e. payment plans  and allowing you to continue commissioning me while the unpaid work is  being paid off, or using the amount of one commission to pay for an  unpaid one.

7.2 - All sales will only be made when the payment is sent and the work is complete.

7.3  - While I do not give credit, I can certainly give consideration of  your situation, and as such, it is highly advisable to let me know in  advance if there are any problems with payments, and can pause and resume commission work at your request.

7.4 - If any completed work is unpaid after 4 weeks without advance notice or reason, you will be temporarily barred from  requesting another commission work until any leftover unpaid commission/s are completed.

8. Your Information and Privacy

8.1  - The information that will be kept by MostlyFunStuff Arts includes  your username, email address and the commission information. 

8.2 - We ensure that this information will not be shared with any third-parties without your consent.

8.3  - You can commission me anonymously, (i.e, being noted on the art description as ANONYMOUS) as well as completely privately. 

8.4 - Private and Anonymous commissions have the same prices and process as other commissions. 

8.5 - Private Commissions can be shared by yourself after the work is completed, as long as I am credited for doing the work.
