About use of patented characters

I'm coming here to clarify some things about the use of Nintendo characters, I know that now the use of Nintendo patented characters will not be allowed. There are also rumors of accounts being banned for using My little Pony characters. But, I was in doubt if the pokemon characters are owned by nintendo, because even though they are your game publisher, but these characters belong to Game freak.
In short, I think it is better not to use these characters here in Patreon's profile. To supply this, I thought about creating fakemon for the profile here of the patreon, with your help of course, with suggestions or even with a new level for this.
I want to know about your opinion of this.

It can be difficult to profit off fan works if the creator is reported by a fan or the IP owners. It can be troublesome if you are attracting too much attention. Fakemons are ideally the best solution to avoid takedowns as you are creating your very own properties, but people may not like the idea of substitutes. At the very least, Fakemons can be treated as original characters you can resell as an adopt if desired.

2020-05-12 01:32:39 +0000 UTCits a shame they are cracking down on it, understandable but a shame to be sure. Maybe what should be done is resurrecting the monster trainer idea and working on expanding that, by making creations and making it its own thing it wouldn't have any copyright issues

2020-05-11 21:57:19 +0000 UTCYeah, Nintendo is going very far in taking down fan art, even ignoring that Fair Use law and going as far as threatening legal action despite all the evidence to the contrary. So best to tread carefully, but if you know for a fact your work falls under Fair Use, with no room for misinterpretation, then they can throw away their money at something they'll lose. Again, still best to tread carefully. Fakemon are easily non-copyright creations, because you created something new that wasn't there before. A new idea, new creation, adding to the original in a unique way, however you must make sure you don't use anything obviously related to Pokemon, like they pokeball logo or recognizable characters, for example.

2020-05-11 17:39:56 +0000 UTCI can confirm Nintendo is taking action against lewd pokemon as another person I'm pledged to used to do a lot of them but he had to relegate those to Discord only cause Nintendo DMCA'd his pokemon art. As for the mlp stuff I think that's only feral as in actual quadrupedal ones but I have heard that go either way.
