Fate won't articulate this very well in series, but servants are not restricted to, or originating from the Holy Grail War. Servants can actually be summoned at any time and place but the sheer amount of mana and magical resources required make it very impractical to most mages and less than worth the effort to mages that could actually pull it off. In the case of the Holy Grail War the grail itself is naturally providing the required energy to summon those servants which is why the mages only need to perform the ritual to summon and from that point on provide a steady mana flow to maintain a servants existence. That is also another large part of why servants and masters don't just spam Noble Phantasms. An average servant can probably only do it once at best without the master feeling the effect and needing to provide the mana required to pull it off.

Regarding Fate: In episode 0, Rin used the pendant to save Shirou and then left it by his body. Then, when she got back home, Archer have it back to her and she assumed he went back and got it. In episode 1, Shirou woke up, grabbed the pendant, and took it home. Make of all that what you will.
