The statement that "Trump attempted to secure an un-elected second term in office", as opposed to insurrection, requires the overthrow of the elected government, which is what the term insurrection means. It also can be argued, or construed as an incitement to violence, as in attempting to meet the ends stated, most often results in the use of violence. The fiasco of Trump and the two party system is due to our inability in the West in particular, to deal with the reality of issue of the inviolability of fake markets money and nation states crashing headlong into reality, and instead retreating further and further into infantile denial. What the problem with reading Hitler's books, I haven't done that yet myself, but I certainly wouldn't condamn who does. I mean, the problem is not reading his books it's espousing and spreading his ideology. Reading a book to learn about the guy is not a bad thing on itself.

To qualify as a insurrection, the bar is intend to overthrow the governement. In som place, you can get up to 15 years in jail for incitement to attend an insurrectionnist riot (like in England or France). A riot in the supermarket, or a random downtown would never qualify. The location of the riot as well as the call to attend that riot qualifies the intent, turning this riot into an insurrection. The shittest one I've seen, but an failed insurrection none the less.

The problem I have with the Colorado Supreme Court decision is that it's essentially based on an unadjudicated charge. They had nearly four years to charge and convict Trump on insurrection charges. While a reasonable person could argue that he qualifies for being barred from the ballot, it shouldn't be up to the election commission to arbitrarily decide that someone has committed a crime. Ballot access is already an unreasonably difficult process, and I'm particularly concerned about giving more power to individuals who are generally unelected and unaccountable in a democratic sense. A ruling like this blurs the line between rule by law and rule of law. It appears to use the mechanisms of the law to achieve a specific outcome, rather than adhering to the intended process of the law.
