No more Harry Potter Audios for now.

I am fighting a legal battle with a company working to copyright strike my youtube channel. I own my audio for harry potter book and they have no ground to stand on. Please wait for audios until I get this crap sorted.

I forgot that I was going to add that everything Harry Potter is or at least used to be very aggressively defended (I'm not sure that's the right word....pursued? protected?) on an Anne Rice level of frothing-at-the-mouth rabid territoriality. As in my 15 year old friend was threatened with a lawsuit BY CERTIFIED LETTER if she didn't immediately take down her FANFICTION.) Insanity. (And that's pretty much what I told him would probably be the best outcome. Mea culpa, claim ignorance, then take the audio off the site, and promise not to do it again, and hopefully they'll leave him alone.)

Yeah I know. I went into the Fair Use Act and what constitutes an educational viewing in my PM. Copyright law is a hairy, hard to understand, sumbitch and it chews people up all the time for the stupidest of reasons >.< and si much of the time, you can't reach a copyright holder because it's some huge corporate entity

Well, that's one good thing. Trust me, getting three sucks, big time. It only happened to me once and I was able to get the copyright holder to retract the takedown requests, saving my channel.

The channel being monetized wouldn't play a role if the video itself isn't being monetized. But even then, a copyright owner could request a takedown based only on the fact that they own the copyright (assuming they are the ones that own it, or are authorized to act for the copyright owner). Fair Use (in the U.S.) could potentially play a role, but if the video is monetized, Fair Use (as I understand it), doesn't apply. Fair Use would only apply if there is no monetary gain by the person claiming it. I'm also not sure that U.S. I don't know if other countries have Fair Use laws or how they would work. I had a public domain movie on my channel at one time, and it got a takedown by the 'copyright owner' and there was nothing I could do... even though it was public domain and therefore no valid 'copyright owner'. So YouTube definitely sucks if you're a 'little guy'. But contacting the copyright owner can help. I got three strikes within 24 hours, back in January 2021 for three different videos that were on my channel. YouTube gave me 1 week to work it out with the copyright holder and if I couldn't, my channel would be deleted. I was fortunate in that the copyright holder was willing to work with me. All I had to do was post a statement on my community tab that I had used their videos without their permission, and of course delete the videos and not re-upload them. They retracted the takedown requests, I deleted the videos and posted the statement/apology and all was well. But other copyright strikes that I've had, the copyright holders wouldn't even communicate with me.

...........not to be negative, but unfortunately that's not how copyright works. (I am not a lawyer so don't take this as legal advice in any way, shape or form, but as an author I do have quite a bit of knowledge about copyright law.) While you might physically own the book/audio, the contents are still copyrighted to and belong to someone else as you did not CREATE it. That's the deciding factor; creation vs ownership. If you weren't the one that CREATED the work, it's not yours. For example, if you for whatever wildly implausible reason you bought the Mona Lisa from the Louvre, you would own the painting but you couldn't then display it with your name on it, because you didn't paint it, daVinci did. (It's not a perfect example as you can theoretically call yourself daVinci all you want to but no one's going to believe that lol)I was just trying to think of something universally famous to use as an example. Copyright can be confusing as hell) If your channel is monetized, and I just assume it is then that would be considered you accepting money for someone else's intellectual property and they have every legal right to smack you. I didn't see a disclaimer over there stating that you don't own the material either but maybe I missed it? (I have additional info but I'll PM that)

How many strikes, three+ or a single one? Are they claiming ownership of the audio or the material itself? Fight the fight, but don't risk your channel(s).
