wow and i thought i was doing too much research by searching "do skunks bite"! you get an A for effort in my book!

I am now 'Answer to the Ultimate Question of Life, the Universe, and Everything' years old

I went down a bit of a rabbit hole (I guess a skunk burrow?) for this one, but it was pretty interesting. The answer is C, because: a) obviously, and b) Yes, skunks are wild animals and it turns out there's Wild Animal Doctrine which would mean he'd be liable if the skunk was his. But once he's released the animal it's no longer his and is therefore wild again, and strict liability only applies if he possesses it. A more interesting question would be whether he was violating any law while he either possessed or released the skunk. It turns out that only 17 states allow you to have one and all but Wyoming have special conditions (permits etc.) to make it legal. In the spirit of the alliterative questions recently I can only assume that Vinny lives in Virginia where it would be illegal to own one. To complicate things, though, the Virginia Department of Wildlife Resources states that: "...licensed veterinarians rehabilitating healthy or recovered wildlife for release back to their natural habitat are required to have a wildlife rehabilitator permit." The question does not state that he has such a permit, the requirements for getting one are pretty strict (https://dwr.virginia.gov/forms-download/wildlife-rehabilitator-conditions.pdf), and Vinny sounds like a shady bastard to me; and so I choose to believe that he does not. Virginia Code 950 section 29.1-505. Penalty for violation of regulations (https://law.lis.virginia.gov/vacodefull/title29.1/chapter5/) states: "It shall be a misdemeanor to violate any regulation promulgated pursuant to this title. Any person violating such a regulation shall be guilty of a Class 3 misdemeanor unless another penalty is specified." Class 3 misdemeanors in Virginia do not carry jail time and are only punishable with a fine of not more than $500 (https://law.lis.virginia.gov/vacodefull/title18.2/chapter1/article3/). All told, Vinny isn't strictly liable for the skunk bite since it was no longer his skunk. But if he's the shady bastard we all suspect him to be then he could be liable for a fine of up to half a grand for releasing the skunk without a permit. Should have got a permit, shady Vinny!

My first instinct is it's a wild animal who bit someone in the wild. Vinny the Vet didn't own the wild animal (again, it was wild since the question says, "back into the wild). The question at hand seems to be if Vinny is responsible since he rehabbed the animal and it was near his house, where it was rehabbed. And, I think this is a torts question. I don't think Vinny owns the wild animal and isn't responsible for its actions. Maybe if it happened while he was rehabbing the animal on his property he could be at fault. That guides me to a no answer. I don't think D is a good answer since you can "own" an animal if you haven't paid for it. If you take part in the cat distribution system, that's your cat, even though you didn't pay for it. That leaves C as my pick. Vinny did not possess the skunk at the time. It was a wild animal he possessed for a period while rehabbing. He relinquished control when he released the animal back to the hiking trail. The kid is lucky they were only bitten. The only doubt I would have is if Vinny has a higher standard of responsibility due to his profession.

Gonna go with C cuz I feel like it's related to like, Good Samaritan stuff, and also nobody would ever be a rehabbber ever if they could be held liable for something an animal did after they had released it back into the wild. Once it was back in the wild as a wild animal, Vinny was no longer responsible for its actions. This is especially true because the skunk was no longer where Vinny had placed it, having moved of its own accord into the neighborhood. He left it on a hiking trail - no mention given as to how far away the trail was, other than it was "local" and that very much depends on how far you're willing to walk in a day - and the child was bitten in front of Vinny's house. Granted, while C maintains that Vinny isn't legally liable for the skunk, the animal's behaviour may suggest it would be destroyed anyway - someone else mentioned rabies, but it could also be simply that it lost its fear of humans. Bad form for a rehabber, but not necessarily a prosecutable offense. (I would also agree that it would be necessary to prove that the bitey skunk was the same skunk that Vinny had rehabbed, but that question is not at issue in the given scenario; this presumes that the prosecuters already proved that point, or were reasonably sure they could prove that point)

This week's question prompted me to look up whether skunks bite at all-- and the sources I found say they *do*, but usually only when they're rabid or have their main defense of their scent glands removed. So UNLESS Vinny gave the skunk rabies or removed the skunk's scent glands, which isn't in the fact pattern, I think the answer is C. Oh another reason skunks might bite is if they're feeling extremely threatened, which makes me think the child was provoking the skunk and it's actually the child's own fault.

Also the "centuries worth of wrangling" was stuff Eastman made up that was in contrast to centuries of settled practice. Not exactly hard for even a state court to conclude, "that's not a thing, it never has been, and we've always done the opposite."

I'm eliminating the yes answers because no one would rescue injured animals if they were then liable for their actions. The word "purchased" rules out D for me because some of us do find our non-skunk pets in the trash, and it would be weird to draw that distinction (although such a law would incentivize adoption over purchase, so maybe I am on board). The word "possess" does make C feel a little off, but I'm going to guess that the legal definition of possession applies here and go with C.

The propaganda "movie" intended to salvage his reputation is super hacky and not being carried on any streaming platforms. T3BE: C Not sure if I heard Thomas guess from the 7 topics of law this time, but this is clearly Demon Law. If the neighbor was possessing the skunk when it bit the child, strict liability obviously applies. This would not remain attached after exorcism or voluntary soul-leaving. Though the question fails to address the specifics of the neighbor ending his spirit-possession, or whether such possession occurred at all, a week having gone by, we must assume that the man was not still possessing the skunk. (Sorry, this joke is based on my dumb mind’s wandering while Thomas was speculating about what it meant to possess the skunk)

At this point I truly see nothing else to do other than despair. The alternate reality where everything is the fault of the woke left secret cabal has been so saturated into our discourse that actual reality no longer matters. Everyone is wrong but me. Great episode. It's always good to call out the lies and rewriting history that grifters and fascists do to keep truth in the public consciousness. For the T3BE, I'd say that the correct answer is C for a few reasons. First, the question states that Vinny released the skunk on the hiking trail, not his property (pin in that) which implies Vinny was divesting himself of the ownership of that skunk, just as a person throwing away broken glass in a public trash can has given up ownership of that glass and wouldn't be responsible for someone cutting themselves on it at the dump. Second, "property" and "possession" seem synonymous to me and property (such as Vinny's land) is something you're responsible for whether you're presently holding it or now. The verb for "possession" is "possess," so I think that's just some clunky way to say Vinny didn't own the skunk, which is established by the first reason. Finally, the fact that it's a skunk seems like a distraction. Imagine Vinny was capturing feral cats, spaying or neutering them, and then releasing them deep in the woods. Whether he spayed or neutered it or not, Vinny does not keep owning that cat just like he wouldn't own a someone else's cat that was his patient. If a feral cat bites someone on your property it doesn't matter if you have a history with that cat, and you just can't be legally responsible for every wild animal that wanders on your property.

At the risk of reopening old wounds, i can't help but contrast w the way the OA community responded to Andrew Torrez. It would have been easy to close ranks around him as a member of our team who'd earned our trust, and we could have dismissed his offenses against others as "trivialities." But that's not us. We were alerted to conduct we deemed morally unacceptable and concluded we were wrong about that POS. As it should be. When your group dismisses the bad conduct of its members and leaders, you just concede to being a group of bad people.

I was thinking about this in another context, but none of us ever earn a bulletproof reputation for integrity. There's literally nothing we can do (nor should there be) that excuses the unethical conduct we might engage in tomorrow. A reputation for integrity is basically a sign that says, "X days since I did something unethical."
