I know it's already been mentioned, but the Luigi case now has a First Degree Murder charge based on the murder being "committed in furtherance of an act of terrorism". N. Y. Penal Law Ann. § 125.27(1)(a)(xiii) NY defines act of terrorism as an act of violence dangerous to human life that are intended to: (i)intimidate or coerce a civilian population (ii)influence the policy of a unit of government by intimidation or coercion; or (iii)affect the conduct of a unit of government by murder, assassination or kidnapping. N. Y. Penal Law Ann. § 490.05(1)(b) How is the state going to prove intent with regard to any of these three definitions of act of terrorism?

Seconded, and is there anything we can do to help? I would volunteer my own time to help with a motion to dismiss in the Des Moines Register / Ann Selzer suit. Although I doubt they need my help; the Register has an article up today called “What is the Iowa Consumer Fraud Protection Law?” It’s kind of like a very Midwest/folksy-looking, apparently-anodyne “just FYI” news piece, but signaling that the Register is super-aware that the statute has no relationship to them, Selzer, elections, or polling, and that they’re exempt from it.

I’d like to hear about this too. Coming from a jurisdiction where “degrees” of murder (or any offence) don’t exist, it’s a bit hard to wrap my head around. Can Liz come back and do a “criminal offences 101” - particularly as she was so sure that it would be 2nd degree murder?

I'm guessing FCA is Fellowship of Christian Athletes. There was one at my high school, I'm pretty sure they're allowed so long as no one has to join. Also, they should also allow a secular version, maybe your kiddo can try forming one (if he wants). There were a few group prayers that went on that made me hella uncomfortable, but there was nothing to be done.

Not a news story but my step son's school is allowing FCA to start a group that meets every Wednesday morning before school starts for bible study. Does this infringe on the separation of church and state or first amendment? This just doesn't seem constitutional to me.

This week there was a school shooting in my city. Many people were surprised to find the shooter was female. Regardless of methodology, all studies of gun violence agree that the vast, vast majority of gun violence is committed by men. This is partly because gun ownership skews heavily towards men. This made me wonder, if we are able to pass legislation that effectively reduces the number of guns owned by private citizens, do we also have to be prepared for legal challenges based on a discriminatory effect? The idea seems absurd but so have many ideas endorsed by the Supreme Court. Are there precautions lawmakers should take while crafting legislation to avoid legal challenges based on the effective discrimination of limiting gun ownership? In general, what is the test used by courts to determine whether an element of effective discrimination should be considered?

Probably with mention that Rep Spartz has indicated that will not caucus with Republicans. It will make things difficult until vacant house seats are filled. And that the Gaetz ethics report will be published. Looking forward to Gaetz-gate.
