I mean, I agree, but if after everything shakes out and Biden/Garland just refuse to release the report and his FOIA is the only way we get this info, then it's going to have to be covered at some point. The fact he thinks it's necessary to bring this suit instead of just waiting to see if said report might eventually come out might be indicative of something, and I'd like Matt's take on if this is something to watch or a nothingburger.

Maybe two footnotes but incredibly bonkers legal news this week: The judge who used chatgpt to uphold an enhancement for "physically restraining" a victim while committing armed robbery at the 11th circuit: https://www.reuters.com/legal/transactional/us-judge-runs-mini-experiment-with-ai-help-decide-case-2024-09-06/ (physically restraining means not "physically" restraining someone) And maybe even weirder: The full en banc panel of the 5th circuit not being able to issue any opinion after almost two years and just throwing their hands up. I'd love to hear about this. I'd also like to see you touch on the likelihood the McDonald's tipster will actually receive reward money. I have read that, even if there is a conviction, the informant has to be nominated for the reward money, it has to be proven that their tip substantially contributed to the arrest and conviction, AND even then, they might receive only a portion of the reward money. Finally, please touch on the concept of jury nullification. Is this something the judge has to disclose as an option to the jury? How would that even be done without bias? I mean there's "hey guys, even if you feel he's guilty beyond reasonable doubt, you know you don't actually have to vote this young man with his entire future ahead of him guilty, right?" and there's "so I'm legally obligated to tell you about this ridiculous option to make a complete mockery of the justice system and vote not guilty even if you think he is". But what is the in-between? Does the jury have to disclose that they are nullifying or do they just get to say they have reasonable doubt?

I'd like to hear about the original charges for the alledged UHC killer. What was the foot in the door that allowed them to search him? Did he have to give them ID? It seems like the initial gun charge and fake ID charge could be problematic if they didn't follow the right path to get there.

The group that was backing Jones's bid was... Surprisingly small? I figured Musk might have chipped in a lot more to possibly keep Jones on air.
