OA1096 - The President of the United States has just pardoned a blood relative and it’s--fine, actually. We review the full pardon of Hunter Biden in the greater context of presidential pardons before moving on to our main story: this week’s oral arguments in the trans rights case U.S. v. Skrmetti. The most important and very likely the most consequential case of this Supreme Court term featured the first openly trans lawyer ever to appear before the high court patiently trying to explain to some of our finest legal minds why a Tennessee law denying life-saving healthcare to certain people based on which letter is printed on their birth certificates is in fact unconstitutional discrimination. Finally, Matt drops a quick footnote to acknowledge one of the shortest periods of martial law in democratic history and to see what we might be able to learn from it.

I agree with the general point that Biden should pardon way more people, but I would leave Ross Ulbricht (aka DPR) off that list. Everything I've heard says to me that he is a real piece of shit. Although he wasn't initially charged with the murder-for-hire stuff (apparently because one of the cops involved in that part of the investigation was crooked - tried to take seized bitcoin for himself), he was separately indicted for it and it was only dropped because he was already serving a life sentence.

I am relieved to hear you agree about the Hunter pardon. I just wish he'd done it in a big bunch of pardons for people currently in jail for stuff like marijuana.

I think the pardon for Hunter for all uncharged crimes is appropriate. I don’t think the cases already completed were as appropriate.
Although, I’m fine with cutting the wind out of the “keep going after Hunter” sails, but I DO want to see charges brought for grifters breaking their oaths, including but not limited to JaKu / Ivanka & Nunez.

Irreparable harm is what happens when a youth is denied the puberty blockers because when they stop puberty blockers, original puberty kicks in. It’s disingenuous at minimum.
Plus Sir Sammy suddenly (again) and Coach Kav putting foreign laws above US laws.

I noticed Gorsuch’s silence. I just can’t decide if he is pissed at the disrespect of even hearing this case, ignoring his careful decision from last term, (joined by Roberts, even) that straight up defined discrimination against trans people as sex based discrimination, by definition. Full stop.
Who is the most disrespectful?
TN AG & Atty who forgot they’re supposed to argue that trans people don’t even exist?
District for the reversal?
Justices Alito and Kav continuing to push their “policy” goals and states rights?
The conservative wing continuing to pretend the 14th amendment isn’t necessary as a federal protection?
We all know that states rights in cases like this are just code for Jim Crow, apartheid and theocratic agendas.

Interesting to imagine what Coney Barrett and Gorsuch were discussing … she seemed a little bit open to some schooling. I was so caught up in identifying with SG Prelager and Mr Strangio’s clear presentations and our Lady Justices accurate understanding of the facts and their combined wiping the floor, logically, with Tennessee’s advocate ! I didn’t notice Gorsuch’s silence and I didn’t think Amy was convinced by “ it’s not sex.” Hoping to be surprised.

I wish the claims of ‘harm’ and 'irreparable harm' could have been put more into their context of studies done on people of varying circumstance, culture and treatment: mostly those without the benefit of the two-doctor approval plus counseling plus parental consent specified in the proposed care regimen. Old studies in a new field suffer from a lack of ‘control groups’ for comparison and tracking. They can’t be adequately peer-reviewed.

I’m always captivated listening to Prelogar argue in front of the Court, but this week had an additional sense of pride since she was taking my state to task. The way she so thoroughly prepares for and responds to any range of legal or factual questions about a given case is absolutely incredible.
