I think it's A as well. I don't think there was a contract as nothing got accepted. You should be able to withdraw your offer at any time before it's accepted, and it's not unreasonable to consult your spouse before you have work done on the house (you'd be insane not to!). Plus, a month feels like it'd be too long to accept an offer like this, particularly since it's urgent damage from a storm. My guess is A. I agree with Thomas's overthinking, but think it's more likely that a verbal offer lapses basically immediately than there's some special rules that only apply to "merchants".

I say A, there must be some reasonable timeframe after which you aren't expected to keep up the "offer" end of an implied contract even if no time period is specified. Otherwise what if Thomas came back 10 years later? A month seems about right for that.

Regarding Kash Patels eyes too wide in pix- i think its cause he has a lazy eye. So when he knows a picture is being taken he has to work at making it look like its a regular eye and he forces his whole eye area…bless his little heart (in the southern way)🤪

Tbh I'm not sure a verbal contract would hold up under any scrutiny, especially not one so informal, but my best guess would probably be technically D, because Matthew offered a service and stated what he would like to get in return for the service, which is how contracts work, didn't technically put any time frames on it, and consulting with a third party who should probably have been involved anyway - legal things about husband and wife being one unit and stuff - mean that, Matthew's busy-ness notwithstanding, it technically holds up all the standards of being a contract. That being said, it's basically unenforceable because it's basically he said-he said and if Thomas wanted to actually hold Matthew to his word he should've gotten it in writing. Matthew being busy with his own stuff as a private citizen is not a consideration for stuff. Or something like that anyway. It's 1am and am no a lawyer

Putting my answer here (copying my own homework from Reddit) because I am a patreon darn it and so I get to do it twice lol I think it's answer A. Offers can lapse after a "reasonable" amount of time and what's reasonable depends on the circumstances. It's likely that a month delay would be seen unreasonable to keep an offer open, especially in light of the damage being caused by storms that probably hit other people in the area who also need this service. I think the question of Matthew being a "merchant" is a distraction since someone who offers to sell something to another is doing a transaction.

just to be random i'm going B - i feel like 'lapsed' is something that would be relevant if a gutter company made a quote as a formal offer and did so with some sort of statement of how long the offer would be valid... but Matthew is doing this informally as a favour from a neighbour in the moment so is not bound by that sort of thing. if my logic is accurate the last two become irrelevant.

I'm thinking the answer here is A. I don't think the details from the original offer really matter because so much time has passed - this new interaction absolutely feels like a new offer from Thomas, one that Matthew is rejecting.

No contract exists, offer acceptance and compensation... Thomas never accepted the offer and a month is not time of the essence... I think this is then a new offer from Thomas to Matthew and he declined it, so no contract. I guess A is the closest so A, final answer. Or E. Great way to ruin a neighborly relationship by charging to do something neighborly and then turning them down, do these two live near me? LOL - Jensie, the neighbor with all of the fences. :)
