More for a deep dive: Can we get a deep dive into McDougal v Fox News? Yes, I know it’s old news but for some reason it comes up every single day, to this day, and people get the ruling wrong. The journalism on it was inflammatory and irresponsible and the ruling has morphed into a shorthand for all anti-Fox News grievances. I’m really, really annoyed by it and it’s making liberals online sound really stupid to keep misreporting it.

Additionally, how can an appeals court stay district court proceedings when neither party asked for that relief? https://storage.courtlistener.com/recap/gov.uscourts.ca5.220895/gov.uscourts.ca5.220895.68.2.pdf

definitely something I want to get into next time we review the Keeping Families Together suit--I'm still not over Barker denying that motion

Matt Cameron

What is an intervenor in a lawsuit? How does an intervenor in a civil suit litigate their interests? Can they bring witnesses or cross examine witnesses? Why would a judge deny a motion to intervene? Is there a recourse to a federal judge not adhering to FRCP rule 24?

Shad Riley

Great suggestion, I am really into ballot questions and this is definitely going into a pre-election episode

Matt Cameron

this may be a deep dive too, but can we get an overview of the abortion ballot measures/challenges happening in the 10 states? esp. in light of MO supreme court recent news (aka bad news for old tinnitus bailey)

I'd like to hear a little bit about the Las Vegas dispute with funding for the baseball stadium. There's been at least a few cases filled, and one dismissed by a judge recently...but the local news doesn't do the greatest coverage.

Quick update, Ovechkin is only 26 goals from The Record

Can you void a contract because the other party does the bad thing that you 1,000% knew about them before you gave them the contract? Cleveland would love to get out of Deshaun Watson's deal and there's a Morals Clause and he was just accused of sexual assault. But he'd been accused dozens of times before they gave him the deal. Could the team approach an arbitrator and say "We want to void this deal because this guy is a rapist" and him say "They knew I was a rapist when they signed me they can't be mad at me now."

Cameron Kushwara

inconveniently for Avery, it was a murder which he definitely committed. Even from what they allowed us to see in the show you just can't fake touch DNA (pretty much the end of the analysis for me), but that was another one where when you start looking into the actual evidence against him in court it is so much more than the show told you. (We joked about this in the original Syed SIO episode but I would totally be down for a limited-run series called "Of Course He Did It" or whatever where we just take these kinds of cases on and show why there was never anywhere near the kind of doubt that these shows were trying to create.)

Matt Cameron

Damn, beat me to it. Here's the video in question, though the legal angle is a bit vague. https://youtu.be/K72abdMZbGA Much of it seems like the producer just trying to extort Ren through him copyright striking the song on YT even though he sold the beat, and there's all sorts of online drama about that, but the underlying law of how these beats are created, licensed, and used is pretty confusing and I think it'd be interesting to learn more about it, using this situation as a prompt.

Michael Morrisson

Can you cover the Ren Vs Kujo copyright issue? Ren published a detailed video with receipts and then a diss track when it couldn't get resolved sensibly (Kujo beat down) - which I'm sure you'll enjoy from a music standpoint

Matt Johnson

This may be better for a deep dive at some point, but I would love to hear your and Matt's thoughts on Steven Avery and everything surrounding "Making a Murderer." I realize this is similar territory to the Adnan Syed case, but this one is complicated by the fact that the local police were on the hook for a previous wrongful conviction of Avery (exonerated on DNA evidence) at the time they investigated and charged Avery with this murder.
