Would love to hear some coverage on this leak from the Supreme Court Idaho decision https://www.cnn.com/2024/07/29/politics/supreme-court-idaho-abortion-emtala-biskupic/index.html

M. D. Nova

Matt, what is your proudest or most obscure motion in or out of court, and would you trade it for a successful Batson challenge? I suggested a Batson to my lawyer in my own case, and the judge agreed. Holy moly, did he almost heel-click when the judge sustained.

Austin Flake

Fair enough -- we're all curious but would rather you be legally safe than quick. You've been through enough and don't owe us gossip at your own further expense.

In line w the coverage re: Grants Pass, CA seems to be taking advantage of the Supreme Court’s ruling https://apple.news/AYNa9oGo1Tsajty9TCB8QuQ

IS SHE TALKING ABOUT ME

I’m really working on this. I don’t know how to get it done without taking like a month off though. There are also other stories to be told as well. Things are happening but not fast enough

Opening Arguments

(Though ofc it wouldn't take up much time in an episode so maybe just here?)

I'm curious what Matt thinks of the theory I've seen on both Twitter and TikTok that the reason Trump keeps referring to Hannibal Lecter in relation to immigration is because he doesn't understand the difference between seeking asylum and being in an asylum.

Kaetrin Allen

Seconded for Casey

Supreme Court Pretextualist

All downside and no upside. Literally no one who wasn't going to vote for Harris would do so bc she picked Romney. And if she won despite him depressing Dem turnout, she's saddled w a VP who would oppose everything she does.

Analysis of the cease and desist letter Nikki Haley sent to the new Haley Voters for Harris PAC

Tom

I thought that OA said that this was a terrible idea recently- saying it makes no sense that if Dems did that it's like scoring an own goal. The far right is so far right that you....cede power in your own party to the right? It could have been another pod but I am pretty sure it was OA.

The actual shark jump was giving Bush the election in a one-off "This only applies to this situation" decision.

Jon C

While you're dealing with intrusive thoughts, maybe Manchin? Or Lindsay Graham.

Richard Murray

Kamala's record as a prosecutor! People are really running with her being a cop, but she wasn't. That seems like a super important point getting lost.

Wishing every Clarence Thomas a very God rest his soul

Yes.

Wishing every Clarence Thomas a very God rest his soul

Though it’s super unlikely, would it be insane for Harris to offer VP to Romney?

A nice, warm bath

This seems like it might be fun to discuss 'Haley Voters for Harris' pledge to fight on after Nikki Haley says cease and desist https://www.npr.org/2024/07/23/g-s1-12998/haley-voters-for-harris-cease-desist-2024-election

Probably a real person

Probably when Reagan tried to appoint a Watergate co-conspirator to SCOTUS. That was the beginning of the long plan to create a court that would enable all the rest.

Gmork

This is more of a deep dive, but I'd love an over/review of Kamala Harris and her record, from Matt's perspective especially.

Michael Morrisson

At what point did American democracy jump the shark? Looking for a SCOTUS case.

Kevin

What legal challenges are we already seeing against Kamala inheriting the Democratic nomination?

Drew Hickcox

The AP is reporting that the Missouri Attorney General just… isn't releasing people from jail? Literally what the fuck? https://apnews.com/article/conviction-overturned-missouri-christopher-dunn-19a632c90b2e571f6a5e52ac9dba62d8

I know the federal courts technically have an ethics code that is meant to prevent judges from straying from good practices. However I'm curious if any judges have been prosecuted for criminal acts stemming from their official role in a case. Are there laws that criminalize a conspiracy to fix a case? If a judge was colluding with a criminal enterprise they would be a party to whatever criminal conspiracies that enterprise was already engaged in. For example in the Kids for Cash scandal the judge was prosecuted for being a party to a tax evasion conspiracy. However as far as I can tell he wasn't charged for any of his official decisions. If a judge like Cannon was found to be colluding with a defendant (e.g. maybe caught on a DOJ wire tap of Trump) but there was no quid pro quo (since she is just a "true believer"), would there be any criminal allegations to make?

Drew Vogel

All (or at least some) of the ways this is fcking stupid? https://www.google.com/amp/s/www.nbcnews.com/news/amp/rcna160779 I've got ex post facto law, bill of attainder, separation of powers, constitutional text would supercede it, the filibuster and the House means it cant pass, and the court would strike it down even if it were legit.

Gmork

Not exactly rapid, but is there any ETA on Thomas answering what he can of our questions on the whole Torrez litigation?

Gmork

Kamala Harris questioning Bret at the senate confirmation clips could be fun. What Matt (and Casey…we miss Casey) thinking about Harris’s time as AG of California

KeepingThePlatesSpinning

(reposting from last week) Trump NY criminal case - Sentencing was scheduled on July 11th but date has been moved to consider Trump's motion to vacate verdict based on immunity decision How likely is it that this verdict will be vacated under the new Presidential Immunity?

Shad Riley

The Sonya Massey murder. I have 2 questions: 1. How often are police shuffled around to different agencies: https://apnews.com/article/sonya-massey-illinois-police-shooting-911-d311a177ceac567cac58f68be810df79 2. How likely is her murderer to see justice?

Xavier Branch

Post-convention, could Trump kick Vance off his ticket in light of how badly he's doing and Musk welching on the cost of adding him?

Gmork

I'd like you to just play clips of Republicans losing their mind at Candidate Harris. You guys deserve a good laugh
