Biden is OUT! Republicans Cry Foul and Lie About the Law

OA1053

We had a different episode ready, but this development warranted an emergency episode. Matt answers many of the most pressing questions about what happens next. Can Harris get on the ballot? Does she get access to the funds Biden had? What happens with Biden's delegates? And is it illegal to drop out of a presidential race... for some reason... as many Republicans are saying?

As far as Nate Silver he got into a back and forth with Jaimie Harrison and Silver accused him of "gaslighting" which sounded overly dramatic to me. But now Silver is working for Peter Thiel, so I think his credibility is shot. Anyway, thanks for your reply!! I'm glad the show is back on track and you all sound good, and I hope you continue to be successful. Thanks for the show!!

The Rs are threatening even more lawsuits to keep Biden on the ballot - tho I don't think he is yet, so not sure how this would work. As far a Ohio, I don't trust Rs with regards to elections - they don't have a good record to put out mildly - so I don't blame Dems for being extra careful, because even a delay could cause problems. So that's why I don't think it's a stunt. Tho it could be both, I suppose.

I do understand what Dems are saying about how sketchy it is that the new 9/1 deadline doesn't take effect until the actual date and how that might open them up to suit for filing in the interim weeks of August but I just don't recognize it as an excuse. Maybe I am not creative enough in my thinking about frivolous litigation but I don't see that suit as a serious threat or how it would survive past when the law goes into effect on 9/1. So while I guess it is literally a conspiracy theory to say that Dems were using this to push Biden through ASAP it is one I happen to believe and from what I see they are just sticking with the 8/7 thing because they had already committed to. (I was honestly not even aware that Nate Silver was also saying this?)

Matt Cameron

Oooh yes. Maybe with Casey on too, since she's a prosecutor? Is Harris a cop or not? #ACAB

can I get a CHEE-HOOOOO

I'm here about the logo too, but cos I can't work it out. It's a whistle, and a bird's head and a white thing. Help me, I'm sure if someone says what it is it will pop into view, but for now it's just abstract shapes, and I can't unser the bird. Is it a turkey?

I like that you kept the "I hate the supreme court" in the opening.

Steve is the word, is the word that you heard

If there is no VP, and anything were to happen to Kamala, Speaker Mike Johnson would be president.

Resident Stevil

A question: you guys said the early nomination of the Democratic candidate (vis a vis Ohio) was a scheme to get Biden confirmed early, by Dems. But you also said Dems were doing it to head off a plot by Ohio Rs. I think it was much more the latter than the former. In fact I think the former is a bit of a conspiracy theory pushed by Nate Silver and others. Thoughts??

Resident Stevil

And would the Senate even be able to reach a majority on VP selection since KH would have to already be president, and no longer VP - so no longer president pro tempe of the senate?? (A moot question, I guess, since house would never acede to any VP choice from KH)

Resident Stevil

Just dropping a thought, maybe a good time to do a new version of the long-ago ep on Kamala? I’ve seen it mentioned on Reddit and people don’t like digging into the AT archives, would be great to hear the Thomas + Matt edition

Log-rolling in my joy for this episode https://westwingthing.libsyn.com/the-us-poet-laureate-wspecial-guest-rachel-larris

I take it all back! The official policy of this show is both Aaron Sorkin and The West Wing sucks and i am Team OA!

Rachel J Larris

Thank you for the ice cream coverage!!!!

The republicans sure have become like Wyle E Coyotee in that episode when he catches the Road Runner. "Now what?"

It has been said many times that the best way to fluster Trump is to ruffle his ego. Mary Trump has repeatedly advised doing that, knowing he always reacts poorly. Do it! Make him feel little. Kamala Harris is *fierce* when motivated. I used to relish her questioning of witnesses in congressional hearings. And one reporter recently said she talked to people who used to work with Harris, and they all said she’s at her best in a crisis.

Pixel Mountain (aka Rachel)

I wanna see memes about Trump being willing to debate a feeble* old man with a stutter, but not Kamala. 😁come on meme makers, make ‘em! *his word, not mine

Pixel Mountain (aka Rachel)

Unserious conspiracy time! Biden's team had an idea about how the debate would go. Biden himself probably did not. Pushing the debate earlier made it undeniable for everyone involved. It's a win win from the team's perspective. Either Biden does nail it, or this can happen as soon as possible. Let's see a debate against Kamala and Trump.

I totally get that, Warren has got that magnetic star power too and I'm proud to have her as my senator. (I just have an extra soft spot for hippies of all ages, what can I say.) I also meant to mention that the state requirements (which came up here in the context of the Heritage memo) you mention are totally unenforceable and very likely unconstitional but have of course never been tested.

Matt Cameron

First - In defense of Matt's crush on Mary Anne Williamson... I'm in my 40s and would RUIN MY LIFE for Liz Warren. I remember the first time I heard her speak on The Daily Show, I turned to my wife and said, "Honey. I'm sorry... I just fell in love with another woman." Second - some states do have a requirement that a delegate must vote for their pledged candidate at least for the first ballot. On Aaron Sorkin's dumb idea... I'm blue no matter who, but I will not vote for Romney. I'll just stay home.

Unrelated - I like the new OA logo! Nice branding. -Steph K

The Kochay

This was my first thought too but fortunately there are no swing states in the 5th and state election laws are so wildly different that I can't see any chance of a national injunction broader than any one state

Matt Cameron

My biggest fear about any RNC election challenges is that Kazmyrski -> Fifth Circus -> SCOTUS just rubber stamp any wacky RNC theories.

Gmork

Vice president is the tiebreaker vote in the Senate (and certifies the election) so it would be an issue if we didn’t have a vice president.

Travis Alexander

Not listened to the pod yet - just here to say awesome logo.

Maria Kladaki

appreciate you guys for the mega quick turnaround!

lauren

And new logo!

Graydon Armstrong

Thanks. Great roundup and analysis! Could you all add book and article recommendations for patreons to go further on these deep dives. Cheers! You guys are the best.

Anything other than running Kamala Harris would be a (bigger) dumpster fire (than it is). But if I had to pick someone, wouldn't it be great to see a Jon Stewart vs Trump debate? I think Jon Stewart would have the talent to make Trump look bad even for Trump supporters. Although Trump would know better than to accept a debate vs him.

Csaba Daday

Awesome. Lovin the new logo too guys!
