2024-06-20 17:46:23 +0000 UTCThe MOORE ET UX. v. UNITED STATES that scotus just decided; as well as Kennedy I’ve seen that there were complaints that some of the facts were wrong. How does a case get to SCOTUS without the “facts” being correct? Was the original trial just THAT poorly argued?

2024-06-20 16:07:40 +0000 UTCThanks for the reply Matt! As someone who's exposure to this case is mostly clips online I can't say I have a well formed opinion on whether she did it, but seeing some of the ways the police have talked about this defendant in their texts that were read in court, I think it'd be hard to argue there's no reasonable doubt to the jury.

2024-06-20 12:51:27 +0000 UTCI sure do, and i love that so many people from so many different places have been following this! Just bc this has been a frequent request i do want to say that we hope to cover it one way or another after it is over

2024-06-20 12:19:07 +0000 UTCYoung Thug trial. It's the other big case Fani Willis is prosecuting right now and it seems to be going very badly. The attorney is serving weekends in jail with his client for refusing to tell the judge how he found out about improper ex parte communications where they are intimidating a witness and may have coerced a confession to a murder in the Judge's chambers without the defence present. Judge isn't concerned rules were broken, judge is concerned that the defence knows about it, and that's why lawyer is being held in contempt.

2024-06-20 11:50:37 +0000 UTCThis @thomas The news that's hitting social media about this is describing it as one of the biggest miscarriages of justice with the judge and Fani Willis's office breaking rules and laws to ensure Thugger goes to jail. How can the judge hold the lawyer in criminal contempt for not disposing who told him that the judge and prosecution broke the law?

2024-06-20 11:48:24 +0000 UTCa specific question I have if this is covered: why is the case brought by a special agent and not a prosecutor? is this an IRS thingy or a NY thingy?

2024-06-20 00:02:48 +0000 UTCI assume bump stocks will be covered on the main feed. That case is interesting to me if only because on very technical grounds, I think it's a correct ruling, but it's the kind that puts the law in a laboratory and not in the real world.
Philly Basement Bar is back open, and isn't taking this shit lying down.
2024-06-19 23:54:05 +0000 UTCThe Baby Reindeer lawsuit! How much can you alter on a "true story" for it to be legally considered true? How much do you have to conceal identities? What qualifies as damage to a reputation? Did she undermine herself by claiming she isn't Martha but then also suing for her portrayal? The world wants to know!

2024-06-19 23:46:52 +0000 UTCRecently Roger Stone spoke to Lauren Windsor and outlined a plan to get Trump in office. It sounds like they have some judges they are working with. "At least this time when they do it, you have a lawyer and a judge — his home phone number standing by — so you can stop it" https://www.rollingstone.com/politics/politics-features/roger-stone-plan-trump-win-lawyers-judges-technology-1235041650/ Presumably he is speaking nonsense because the judge can't do much from home when court is not in session, right? Since even nonsense illegal stuff happens though, could these comments be used by the other parties in the case to seek a new judge? He doesn't name anyone specific but it seems to cast the shadow of corruption on whatever judge receives a case where Stone or the Trump campaign are parties, even if there was actually no prior coordination. How would these types of allegations be adjudicated?

2024-06-19 23:34:34 +0000 UTCI know I phrased it as a question, but I wasn't asking for an explanation. The statute defines machinegun as a weapon that can shoot more than one shot, without manual reloading, by a single function of the trigger. The majority takes your view that a single function of the trigger is a single pull of the curved metal piece of the firearm called the trigger. A bump stock uses the forward pressure provided by the shooter to push the firearm back into the shooters finger to fire the weapon again. Therefore a bump stock requires multiple functions of the trigger. While I agree that this is a reasonable interpretation of this statute, another interpretation is plausible as well. The forward pressure on the foregrip is what triggers the weapon as long as the shooter maintains a tight hold on the pistol grip. Notably, this statute does not say single "pull of the trigger" instead it says function. I would argue that the forward pressure that begins the firing sequence, continuously firing the weapon, is a single function of the trigger.

2024-06-19 23:22:43 +0000 UTCDefinitely hoping to see some discussion of this. I can understand the procedural issues that got it overturned, but I feel like a lot of people aren't pointing out that the Majority seemed to take a massive step in neutering the NLRA re: its ability to request §10(j) injunctions by effectively forcing the circuit courts to evaluate and 'litigate' cases it has no jurisdiction over, just to fulfill the four requirements set forth by Winter, most specifically the success on the merits.

2024-06-19 23:17:37 +0000 UTCA doctor (or maybe just med student?) has been charged with illegally accessing and leaking the medical records of trans children in Texas to Chris Rufo for moral panic purposes. I haven't seen much coverage outside of trans and queer journalism circles.

2024-06-19 23:15:37 +0000 UTCHello, lefty learning about guns here. A single function of a trigger is a single pull. A semiautomatic weapon re-“cocks” itself with the exhaust gasses of a fired round, so you don’t need to do anything to prepare the next round to be fired, but you do need to release the trigger and pull it again. A fully automatic weapon will fire round after round as fast as it can while the trigger is pulled in a “single function”. This is often what people think of as a machine gun. Semiautomatic weapons have many legal and accepted uses for hunting, self defense, and police work. Fully automatic weapons, generally speaking, are not legal (although you bet there are exceptions).

2024-06-19 22:51:49 +0000 UTCIt has been a crazy week and there is so much to cover. I'm just going to list a bunch. 1) New immigration Parole in Place program. Why is there an up to 10 year bar to noncitizens who remained unlawfully in the U.S. 2) Bump stock SCOTUS case. What is a "single function of the trigger"? 3) Louisiana law now requires public school classrooms to display the Ten Commandments. Establishment clause? 4) Young Thug trial. Idk even where to start. Judge has ex parte meeting with prosecutors and witnesses (yikes). Then when the defense attorney asked whether this meeting happened, the judge demanded that the attorney provide the name of his source. When the defense attorney refused, the judge held him in criminal contempt. There's so much more but that is pretty shocking.

2024-06-19 22:38:13 +0000 UTCExactly, it’s small from a worldwide perspective (compared to the AJ bankruptcy or something), but it impacts our community enough that I think boosting it is worth doing

2024-06-19 22:32:28 +0000 UTCAdding to the Alex Jones thread: why was he approved for personal liquidation but Free Speech Systems was kept in chapter 11? They're basically indistinguishable. Also, he's blatantly directing people to buy his "dad's" supplements now and it's very obvious he's trying to skirt the bankruptcy. Is he going to end up penniless AND in prison?
