The Mifepristone Case Is an Insult to the Concept of Standing

Episode 1018 - GOOD NEWS EPISODE!

It's positive vibes only as we celebrate the impending disbarment of MAGA law toadies John Eastman and Jeffrey Clark, the first but-actually-for-real-this-time Trump trial date, and some extremely real threats to your favorite President's sacred First Amendment rights to lie to the public and terrorize the families of court personnel.

In more good news, the Supreme Court couldn't seem to find an actual excuse to ban medical abortions this week--or even find anyone who could even claim to have been in the same ZIP code as someone harmed by mifepristone--so we take a good look for ourselves and don't find too much to worry about.

One more bit of good news: Matt wants to give you a job! (Inquire within.)

1. John Eastman's two-page proposal to overturn the results of the 2020 Presidential election

2. Judge Yvette Roland's full 126-page decision to the CA Supreme Court recommending John Eastman's disbarment (March 27, 2024)

3. Judge Merchan's gag order (3/26/24)

4. Trump's motion to dismiss GA charges on 1st Amendment grounds (12/23/2024)

5. Transcript of oral arguments in FDA v. Alliance for Hippocratic Medicine (March 26, 2024)

6. Federal judge Matthew Kacsmaryk's  mifepristone ruling (April 7, 2023)

7. Application of Comstock Act to Drugs That Can Be Used for Abortion (USPS General Counsel)(12/23/2022)

8) 18 U.S. Code § 1461 - Mailing obscene or crime-inciting matter (Comstock Act)

Came here to keep spreading my gospel which is that the Alliance for Hippocratic Medicine is also essentially "a piece of paper" that was incorporated right after the Dobbs decision to serve ADF's purposes. https://newrepublic.com/article/179626/mifepristone-abortion-supreme-court-alliance-hippocratic-medicine?fbclid=IwAR3Vt_6ZqIWydtXhfwTnwLVjl5ykgdDZDArBs1kNun9a6DhY3adYTLniFB4#:~:text=The%20biggest%20abortion%20rights%20case,used%20for%20medication%20abortion%E2%80%94is

agree. 'il scalito' = 'the climber' in italian. which feels extra apt.

In reference to the mixing up of Alito and Scalia... I think the term Scalito should apply.

Don't use bad yarn as a life line in a fae yarn store. The yarn fairies will immediately remove it and you will get lost.

Just to name drop, I totally took a course from a former Alito clerk and aced it. As for his intelligence, I would say he is an excellent sophist. He can reverse engineer an argument from his preferred outcome and usually make it look apolitical. Whether he does it in bad faith or not is up for debate, but he has real skill for writing and no shame about flatly contradicting his prior views without so much as an acknowledgement of the change. His majority opinion in the Bladensburg Cross case, for instance, has a great deal of surface plausibility.

Dr. Clerk

Regarding the mifepristone case, one useful parallel would be if a doctor was called in to the emergency department to operate on a patient who had just committed a murder in the ordinary, agreed-upon sense of the word, and was severely injured (maybe shot) while being arrested. That kind of thing happens. After the surgery, the suspect/patient might be chained to a bed in the recovery area while a bunch of police officers stand around keeping watch and waiting to take them to jail. But still it's the doctor's duty to perform the operation and save the life of the murderer if she or he is physically able to do it. As a matter of medical ethics, a medical professional's responsibility to administer necessary medical care doesn't depend on how a patient got into the situation that requires that care; it depends only on the needs of the patient.

Sure. Eastman can wear his disbarment as a badge of honor if he wants to, like a dueling scar. Even for a position as a justice of the Supreme Court, there's no requirement that a person be a licensed attorney.

Happy soon birthday to Arlo

Purely Hypothetical

I have a question Regarding Jeffery Clarke’s disbarment and idea that DJT needs new lawyers bc these guys will be disbarred…. I know this limits their powers but if they are disbarred wouldnt they still be able to consult and possibly hold top positions in Trumps future admin if he gets elected?

Regarding the FDA rule changes, for the longest time it was easier for me to get my ADHD medication which is, you know, a form of meth, than it was to get these drugs (not considering recent shortages and all that).
