2024-03-29 06:29:14 +0000 UTCSouth Carolina redistricting plan Federal District Court found the redistricting plan unconstitutional under the 14th Amendment on January 6, 2023. The state legislature appealed to the U.S. Supreme Court and the District Court said the state had 30 days following a decision of the Supreme Court to create a new map. The Supreme Court has just been sitting on this since then. Now, the District Court has modified its injunction, allowing this unconstitutional map to be used in the 2024 election. The court cites Purcell v. Gonzalez, 549 U.S. 1 (2006) which states that courts should avoid imposing significant changes in election procedures shortly before an election. This is ridiculous. I see that Zynga had a similar case that led to lawsuits against the board, but couldn't find the final outcome. Maybe this isn't a "quick response" question, but what do you think would happen if they let Trump's stock out of jail early??

2024-03-28 03:38:56 +0000 UTCI am curious when they deport someone do they always send them to their country of citizenship, or can they just send them to Mexico if that is where they crossed. Even if that is the case it seems Mexico would be well within its rights to deny at least a non-Mexican entry. Or how about a Mexican citizen that had no papers to prove they were Mexican can they get in no questions asked. I assume many of the people being deported are not carrying a passport or other proof of citizenship. How do they get through border control of their country of citizenship if they are put on a plane? There may be ancillary issues and problems about the final step of deportation I have not considered that I'd love to hear Matt discuss

And how they could fail to treat any hypothetical patient having an adverse reaction to it? I'm sure they have a religious and moral objection to heroin, but would they deny care to a patient suffering from an overdose? I know they're probably being disingenuous, but they should at least use enough logic to fool a two-year-old. It's insulting. I would also like to propose the occasional Lawd Awful Book Club? Perhaps Justice Stephen Breyer's new book?

Also he apparently pled the 5th repeatedly in the proceedings. The health insurance system currently used in pharmacies was hacked and disabled 4 weeks ago and it is still not back up. This has led to people not being able to get their medications because the pharmacy can't charge their insurance provider. But the legal angle is that the company, united health group, is facing a class action lawsuit from those people who couldn't get their medication. It would be an interesting place to dive into what can be claimed in a class action. Reimbursement for the out of pocket money I would assume can, but what about medical bills from people who couldn't afford to pay the price for medicines and had complications arise afterwards?

2024-03-27 23:28:55 +0000 UTCThis isn’t the most pressing news, but something I’ve been seeing/hearing about a lot lately is the whole “squatter’s rights” thing and, on the principle of “if it sounds ridiculously unjust then it’s probably not part of the justice system”, the idea that someone just wanders into your house and now you can’t kick them out seems a bit farfetched. I know in NY the rule is basically to take property it has to be adverse possession, aka for 10 straight years you’re an illegal trespasser who could be removed immediately, or after 30 days of not being removed you become a legal tenant, who can still be evicted btw that just takes time because we need more judges. So these stories, at least in NY, are at best someone who failed to inspect their vacant home for 30+ days and is now attempting to evict a de facto tenant, not someone who wandered in and stole their house. Would enjoy a debunk of these news stories that are popping up

Perhaps the family requests the funds to be used for a particular purpose, or perhaps the organization offers to use it for some purpose -- in either case, to honor the deceased. The organization does not use the funds for the stated purpose -- perhaps they use it for some other purpose, or perhaps they never reveal what they used it for. Does the family, or any survivor, have a cause of action against the organization?

News about one has been making the rounds recently ( https://www.aclu.org/news/privacy-technology/communities-should-reject-surveillance-products-whose-makers-wont-allow-them-to-be-independently-evaluated ), but there are others, for sure. These always feel like different branches of the gov't hiding the scary bits behind a private company, but I'm cynical. Is there more to it than that?

I am concerned that the court is getting a lot of positive press coverage for looking like they’re going to overrule the 5th circuit despite an argument that showed they’re extremely open to fetal personhood and the executive branch enforcing the comstop act.
