More generally if information from government officials preferentially disclosed to one group yields insider trading liability wouldn't this lead to exceptionally broad liability, eg, suppose government scientists working with company A on COVID vaccines reveal some pre-publication scientific result that affects their decision about whether to purchase some company with a canidate vaccine would they then be liable for insider trading? It might be unfair but I worry about potentially hamstringing the ability of the government to work with private industry.

I mean sure, it's awful but surely the donors didn't owe a fiduciary duty to the companies they traded or did they write executive branch officials directly into the law. I mean it obviously should be illegal but I’m wondering if someone who knows what they are talking about can tell me if it is.
