Could be one has to be physically present to experience him and Happy Jack is inside that suit while Max is way off in some facility somewhere. But doubt we'll get that explained. ;3 With his zany powers half the point is not understanding the weirdness. HA! That would be even funnier if Max can't see him because 'The Weirdness' doesn't like Max's tendency to need everything be explainable.
