I realize I’m too late to add this as a topic but August, but want to see if others are interested in this as well. From the recent article by William Baude and Michael Stokes Paulsen, “Second. Section Three is legally self-executing. That is, Section Three’s disqualification is constitutionally automatic whenever its terms are satisfied. Section Three requires no legislation or adjudication to be legally effective….[No] prior judicial decision, and no implementing legislation, is required for Section Three to be carried out by officials sworn to uphold the Constitution whose duties present the occasion for applying Section Three’s commands. Section Three is ready for use. …” If no adjudication, impeachment, etc is required for Section 3 to apply - and I agree, a reading of the text does suggest that - then who decides whether trump did fulfill the terms? Is it up to individual election officers, the RNC leadership, state AGs, and anybody else with power over the nomination and election processes to decide this and act? How does it work if some of them conclude that Section 3 applies and other that it doesn’t?
