The Crunchyroll translation for this episode and next one was not good. There are two empresses involved: current Empress Dowager Anshi, and the one Shisui briefly mentioned: the mother of the late emperor, who was just referred as "the empress". These are two distinct characters, with the latter being translated in LN as "Empress Regnant" (lit: THE Female Emperor)

I doubt that will ever be made public, so we should all just get on board with that he is The Emperor's brother.
